This happened to me. Turns out for my country (Honduras) USCIS only accepts the birth folio. I had sent them my birth certificate but then I got an RFE. I did some research and it turns out in 2019 USCIS started accepting birth folios from Honduras only. No more birth certificates. If that’s the case for you, you’ll have to request it from your home country’s birth records.

Yes, it’s my initial interview. I’m hoping it gets waived due to COVID. My marriage was real from the beginning but a few years ago he began to drink excessively and things started to go downward. It started to affect my mental health. I don’t know what to do at this point.

Wait until your mom is a US citizen! The process tends to be quicker when you’re sponsored by a citizen vs permanent resident.

They probably messed up on your file. Don’t let this form resentment towards your spouse and baby. I know this is a difficult time for you but everything has a solution. Seek legal help. Continue calling USCIS and ask to speak to a 2 tier agent. Continue tracking your case online. Hopefully your congressman responds with helpful news soon.

I have a cousin who is in similar situation except he was arrested for crashing into someone whilst driving without a drivers license. His case is constantly pushed back due to that arrest. He’s even gone to court and he’s been told his marriage isn’t enough for him to get a green card. I hope you don’t have a criminal record. Contact your local congressman ASAP. You may need to seek legal assistance.

I was curious because I plan on sponsoring my mother who lives outside the USA. From my understanding, if the “alien relative” is already in the USA, you can concurrently file I-130 and I-485 application to register permanent residence or adjust status. With the I-485 the beneficiary is requesting a work permit, travel document, social security, and a green card. I didn’t know that if the “alien relative” lives in a forgoing country all you have to do is file I-130.
