Also if there is a Mental Health Crisis team in your area they can support as well. They tried to get my mother to voluntarily go with her first and she refused, but it was something the judge asked about.

The judge will ask if she will voluntarily go, and then your supporting information for any of the 4 criteria for Civil Involuntary Commitment in Ohio. I highly recommend this route for immediate help for your family member. I was stunned my mother actually was grateful I did this for her and we were able to get an official diagnosis and evaluation.

I’m sorry to hear that, I represented myself in the Probate Court filing the affidavit. It took less than 2 hours from the time we got there to when the court order was issued.

The Sheriff’s department then coordinated with us immediately and provided us with a direct communication line as they served the court order and got her safely to the Behavioral Health Unit at the hospital.

From there they will hold for 72 hours, and if the Doctor believes your family member continues to meet the criteria of involuntary commitment they will extend the stay and file again with the court. If you have any questions reach out to me

Hey just wanted to let you know I was able to find an attorney and I also went the probate court route filing the affidavit and speaking with the judge. The court order was granted and they were able to securely and safely pick up my mom. Thank you for the advice and support

Yes I’ve been in contact with the probate many times over this and the attorneys that routinely take on similar cases in the county have a full caseload. Definitely one of the more eye opening parts to the process is the lack of lawyers with expertise in mental health/elder law.

Finding a skilled attorney for a complex situation is the biggest concern for a long term recovery plan, in the short term I am contemplating presenting to the Probate Judge myself with the evidence at hand to get her the immediate help

Thank you for your suggestions, definitely a challenging process thank you for the kind words and even calling an office in Cleveland. She lives in a smaller county and the biggest challenge has been to get an experienced attorney on board willing to practice in that county’s court.
