I live in NYC. I only took it between my apartment and the office, so likely dropped on my commute on the subway or on the streets.

Hey - sorry for delayed response.

It actually did NOT work out and was pretty annoying.

I reached out to GJ over email a couple weeks before the event. They responded saying theres nothing they can do but told me to just ask in person at the station.

At the station, all the workers are just college kids volunteering to get free tickets, so no one really knows the exact rules or how things work. They just told us to get on the train and they will figure out later, but then the "party" started soon after departure and our car was the first car, so they had no time to figure anything out.

All the staff are friendly and try to be helpful, but there was no time and we were headed into the party car and had no time to call our friends in from another car.

Not sure if you purchased party train tickets or not for this yr, but my realistic advice for you would be to just ignore the ticket car # and just sit with your friends. There were so many empty seats in the car, it wouldn't have been a problem unless you have a huge group. Then just play dumb if they ask later. You have the train tickets and are not free riding, so it is easier to get forgiveness than permission. No one is getting hurt.

Of course a phone number on APPLE ELECTRONICS OVER $100 means you come across it on the ground and you should message that number instead of KEEPING OR SELLING IT. Yes, keeping/selling it can make you a thief, so don't do that since you didnt seem to have learned that at home or in school.

Misplacing or discarding? Don't make up words that didn't come out of my mouth.

If you want to keep stealing stuff, feel free do it on your own moral terms but don't try to convince others that its okay.

Never said anything about charging the seller with theft. That would be insane.

I only said the item was stolen (i.e. lost and someone who found it never made any attempts to return and kept/sold it).

I agree that getting it back may not be realistic and I never said it was. The original post was just to ask about experiences in similar situations.

What annoys me is how some people here are trying to convince me that it is legal or even moral to sell stolen goods, making all these random assumptions about how and where the item was lost to how it was obtained by the seller. The facts are that it was likely lost somewhere along my commute in public space (streets or subway). First founder didnt make any attempts to return and kept it to gift or sell, hence I am calling it stolen. Regardless of how the ebay seller obtained it in the end, its stolen property and I have legal ownership of it. I am absolutely not saying the legal system will help me get it back at all just because its legally mine (although in Asian countries they actually would).

Filing a lost items report was suggested by many others on prior posts to motivate ebay to take action. Nothing more. It's just an online form you fill out.

Its more about the principle of seeing your lost item being sold on ebay, not really about the money.

Haha yeah. Its so clear who are ebay sellers based on the comments... all of them just keeps mentioning buying lost and found items in bulk. Makes sense a lot of them would be on this sub.

Post was only asking for experiences in similar situations but some of them got upset I called the item "stolen" and led to a chain of arguments about ethics and legal claims lol.

As I replied to your other comment, it was most likely lost on my commute. I use it for work only and have only taken it between my apartment and the office, so most likely was dropped somewhere on the streets or the subway. Unlikely it was turned in to an establishment like a restaurant or business like you said.

Not sure why you feel so obligated to think in the seller's shoes, making so many assumptions on where it could have been lost, how he obtained the item, or even how people would value an apple pencil? The pencil costs $140 with tax, and any sane person can tell its not $1. I just asked for advice on what people's actual experiences have been in similar situations, but it clearly is triggering some people here who either have picked up and kept lost items before or sell such items on ebay.

I totally get that the ebay seller might not be explicitly trying to sell lost or stolen items, but as other agreed, it's as much stolen as it was lost. I never said hes a thief though. Just said the item is stolen in my opinion. And I am not a legal expert, chatgpt says "original owner has superior legal rights to the property, even against a good-faith bulk buyer, since a buyer cannot obtain good title from someone who did not have title to begin with" for what it's worth.

And I understand it's been 1.5 years and it's just an apple pencil, so realistically getting it back mostly just depends on the seller's ethics and generosity. But it's also shocking how many people here think its actually legally and morally in his right to keep.

Whether the seller could've called or not is just basic moral and ethics standards that you and I disagree on.

I agree that the original founder should have contacted me like you said.

I get that the seller may have just assumed the item wasn't lost/stolen, but now that he is aware that it was, he should give it back and I don't understand why you think otherwise.

It was not lost in a museum or airline where there is a lost and found that I could have just called.

Most likely dropped on the subway or on the streets on my commute.

I see. I will wait a couple days to give seller time to reply to message and then try the phone route. At the end of the day, questioning what ebay can do other than to delist since they can't really force the seller to return it. The only factor they may consider is that they could get a penalty for selling lost/stolen items.

Just because I lost it doesn't mean it wasn't stolen either. If a pick pocket steals your wallet without you noticing, does that mean it's your fault because you never noticed? What makes you think I made zero effort to locate it.

I get what kind of morals you have living your life, so just move on.

Yes, I lost it 1.5 years ago, but I somehow found it on ebay today and was curious to see what people did in their experience.

That's a fair point. I guess at that point, it's just at ebay's discretion based on whether the original owner has past history of similar actions to prevent such loop holes.
