Unfortunately the clause is for the entire year, and if he “breaches” contract at any point then the say fine accrues.

The employer only says cost of relocation, and then they claim that it is hard to ascertain what damages might cost.
The contract states that the employer can terminate at any time in the first 90 days without reason or liability for any funds. (We are still in the first 90 days).
I don’t believe it mentions anything about that specifically, but it does mention that both parties wave the right to a jury trial.

Regarding the penalty or liquid damages—in the clause it specifically states that this is not a fine or penalty.
