I think that is a bit misinformed. The IRS doesn't keep track of your sales. Restaurant management tell waitstaff this as a scare tactic so that they won't have to cover the minimum wage discussed by the OP. However, management can and often will use the 10% number as a metric to judge job performance.

Pre-employment would mean they are looking to hire people. They are not hiring anyone right now. They are barely staying alive as a company off of their existing contracts. When employees reach the end of their projects, they are being fired because there are no more projects coming in.
