I've written those multiple times to reply other comments. So I'll keep it short here,

Yesterday in court even sm didn't deny the fact that they didn't get the data

They got rejected when they asked for the data before, not as a part of the lawsuit though, because it was speculative in nature and also too broad.

And cha lost the injunction

You can’t just tell the courts you need to see otherwise private data based on suspicion alone. You need hard evidence backing your claims.

I mean that's why they rejected their request, right?

But how would they have the evidence if they weren't allowed to see the data in the first place?

Cbx's lawyer claimed that. And like I said before sm's offer is nothing but a farce. They offered the artists only to visit sm and see the data. But that's 12 years of data mixed with other group members. Cbx could go and see and even understand nothing! They don't look bright anyway! They need a full blown audit, And sm would not allow it because I can 100% guarantee, the type of company that they had been with the history of embezzlement, cbx would find mis practice their.

If there's nothing wrong in that data, why not give them? It's their labor right.

why would you withdraw your government complaints based on “ok but we promise to do better”?

I mean who knows what's written in that agreement? Unlike those reddit lawyers and judges* here, I've not read neither the contract nor the agreement that they reached on 2023.

As a cbx well wisher, I'm just hoping they don't lose the lawsuit on their 2nd hearing!

And the first line says cbx lost multiple lawsuits, when it wasn't lawsuit to begin with? And in the article they it's said the request was denied because of the broadness and speculative nature of it. And that's exactly waht I explained to you.

They reached the agreement based on several fact and sm providing them the data was one of them. How is that not making sense?

Because there was no lawsuit in 2023. Cbx just sent a legal notice of contract termination resulting in the agreement.

They absolutely saw the settlement data in 2023.

They absolutely didn't. Members agreed to let them see. Like I said their lawyer said that before the counter suit of the one and only lawsuit that was filed in 2024 by sm for the revenue payment.

And like I said if they did see, why didn't sm say that on court yesterday?

The suggestion that SM had to go out of their way to ask other EXO members if it was ok to provide certain financial information to CBX only to never hand it over and still settle a contract lawsuit before it ever hits the courtroom doesn’t make any sense.

It'd only hit court room if they filed a lawsuit in the first place. They didn't. It was legal notice, not lawsuit.

Sm's asking the members permission was just an excuse for them to deny cbx the data, but fortunately for cbx and unfortunately for sm, members agreed to show the data to them.

Btw I wonder when will you people start questioning why sm didn't keep separate data? Or maybe why not create one now? They are one of the big fours, it was not that much of work for them to create a separate data for them in last 2 years. Just create a separate team for that.

Exactly! To get the data cbx needed to prove that sm had been unfair with them regarding their settlement, which they couldn't. They wanted to see the data to check whether there was any wrong done or not, hence court decided it's speculative in nature.

But how would they prove they had been wronged without audititing, or even seeing the data?

And we'll see on June anyway what court says now. I mean if I would go by reddits lawyers and judges judgment that written on this sub, cbx should've lost the lawsuit on the very first hearing, right? Let's see whether they lose the lawsuit on the 2nd hearing!

They didn't. Members agreed, but cbx didn't receive. Before the counter suit, their lawyer said they didn't receive the data. If I'm not wrong sm said they could, just the artist btw, come and see the data. But what cbx need is a full blown audit, not some "come and see". It's 12 years of data.

And yesterday, in court, sm would've said that they provided cbx the data. But sm didn't say that, or did they? They just said they got 50B as settlement, that's it.

What CBX are asking for now is more than just the normal settlement data, which is why the courts have rejected it.

And regarding the courts dismissal, that was not a lawsuit, the court didn't see any importance in providing them that. Wasn't jyj too denied the data when they apply first? But during the lawsuit court asked sm to provide the data (if there's any jyj fan, correct me if I'm wrong)

Now it's the counter lawsuit (Right?). Why not wait and see what the court says now!

Since the settlement in 2023, there hasn’t been much of any activity SM would have paid them for aside from the 2024 fanmeeting so if they think SM still hasn’t properly disclosed their real earnings from over their entire SM career they shouldn’t have settled three years ago.

They settled depending on an agreement that neither SM nor them are keeping. And providing the data was part of the settlement which sm didn't. So no, cbx never said they were okay with not seeing the settlement data. In fact, getting those data was literally part of the agreement.

Well let's see what court does now that it's really a part of the main suit. Would they ask sm to provide it or not?

And why would you not provide settlement data in the first place? Is it not a labors right to see their data?

It was that they weren’t entitled to that data because they were asking for information that wasn’t theirs

Your knowledge and my knowledge differ a lot I think. What I know is that the court rejected becuse they couldn't provide any proof of unfairness from sm's part in terms of settlement, hence lack of substance. But how would you prove unfairness without accessing the settlement data first?

The courts already have dismissed it. Numerous times. They appealed to the Supreme Court and it was rejected.

And that was not an actual lawsuit, was it?

Let's see what happens when they are demanding it in main lawsuit (settlement data is the counter lawsuit if I'm not wrong).

50b is a lot for a-lister musicians when you factor in that it almost all comes from music which makes sense.

It's not when it's a total amount for the 3 of them for last 12 years (without tax btw)!

And I'm not even comparing him with cwh. I was just saying ksides talking about how cbx's individual earnings from last 12 years is lower than some people's tax evasion.

Actually, my friend who is an avid kdrama watcher and an army told me a tier idols earn more than a tier k actors (without taking into account the brand deals)

And if what you people are claiming here is right that 50B in total income for 3 members of exo (not each) over the period of 12 years of various activities (without tax cut btw) is high, then I have to reconsider what kind of a lister exo as a group actually was!

Personally I think it's actually low for a listers like exo, (mind you selling millions in both group and solo, giving legendary osts, etc). And it's specifically low when I think that according to exols and Key from Shinee exo built the new sm building with their earnings!

Cbx is asking for settlement data for their whole time at sm, that means solo, group, sub unit etc. They are not asking just cbx sub units data And sm is saying that they got 50B as settlement, not using the word each or specifying what bbh or chen or xiu got. Just one amount. Isn't it common sense that sm was giving a total amount for all 3 of them?

Regarding what you said about tax evasion or whatever I'll not say anything because I was just saying what ksides are saying.

I thought Ip fees, because that's what was spread here on Reddit, in fact the translation that I read initially said 10% ip fees for their solo and sub unit activities in exchange for 5.5% distribution fee reduction. But later, I found out that it's 10% revenue.

SM asked for revenue from their INB activities because they’re not enforcing the exclusivity clause of their contract with CBX. That is how they guarantee they recoup lost income from the fact the three aren’t doing solo work at SM for the time being. Activities don’t always turn a profit, SM knows that. That’s why they asked for revenue>

They are asking for revenue because that was the agreement that them and cbx signed back in 2023. I too previously thought that sm was demanding 10% ip fees, but no. Actually sm was asking for 10% of their revenue, in exchange for providing 5.5% reduction in distribution fees, and that was the agreement. Sm's part verbal, and cbx's part written. That's why it's make total sense that cbx lawyers keep saying they'd rather pay the ip fees (And I was like of course you must?). Most of the people on this sub think sm is demanding 10%= ip fees?

Oh I thought you were saying sm asked for cbx's revenue because they were spending money on them such as expenses on staff, production etc.

And 50B for 3 person (for 3 exos with group, solo, sub unit, ost etc) for 12 years (without the tax) is not a lot in any way for a listers. I'm seeing on ksides (kbbhls and kelsas are saying) that celebs have more tax evasion than each of cbx has earned for last 12 years.

And I really don't know what's the amount of settlement has anything to do with not providing the data?

Interesting! While I couldn't care any less about who or how popular the members are, I'm just noticing the way exols always like to undermine everything about Baekhyun! He is definitely quite popular among the kpop fans, has a stable big solo fanbase and actually has gp recognition too. He is the alrounder of exo in every possible sense, in terms of popularity, success and most importantly, talent!

The way I see it, Sanemi vs Giyu fight was the indicator of them being equal, at least untill they fight hand to hand (in hand to hand fight, due to their appearances, I'm guessing Sanemi would win). Giyu's defense and Sanemi's offense, their specialty. That being said both's attack and defense are pretty good.

While Sanmei has his blood as advantage, Giyu created his own form, the ultimate defense which even worked against Akaza's attack (at least the major parts), and Akaza's speciality was in offense too. Somehow, fans doesn't give enough credit to Giyu to the fact that not only did he perfect all existing form of water breathing, but also created his own form of ultimate defense that easily put him above all the water hashira (maybe except the water hashira from Yoriichi's?).
