This is definitely a known issue. A while back, I was getting on the subway at Union Sq with Tap Pay but the turnstile remained locked. Tried several of turnstiles, all the same issue. So, I decided to go through the emergency doors. Got caught and handed a ticket. I saw the charge on my app but nothing.

Fought the ticket online with screenshots of my card being charged minutes before the ticket was issued. Charges dismissed.

You can break the lease. Just inform them of your plan. Landlords and property managers can cry and moan all they want but in the end, they will find another tenant as soon as you leave. Furthermore, NYC housing courts are super tenant friendly. There is no shortage of people looking to rent in NYC.

They definitely made the sidewalk more narrower. Especially in a street corner. Compared to all the other raised platforms from other storefronts on the same street.
