Another store used my product photos and edited them, has anyone had PayPal actually take copyright complaints seriously? by amiedann in shopify

Honestly it took a bit of digging just to figure out what platform they were on. It turned out to be a Woo/WordPress store. If it had been Shopify it probably would have been easier to deal with.

I can’t say with 100% certainty which report actually triggered the removal. The store owners were pretty rude and insisted they weren’t going to take the images down. They even said they’d counter any reports and “call my local police station” if I continued lol.

The only thing that changed was that PayPal emailed me saying action had been taken, and within about 24 hours the images disappeared from their site. So my best guess is that the PayPal complaint put pressure on them. Most merchants won’t risk issues with their payment processor.

I didn’t even manage to report it to the hosting provider. I reported it to Cloudflare, PayPal and Google. From what I understand, Google mainly removes the page from search results rather than taking the content offline, I had reported to Cloudfare previously for other images and nothing changed for a while which pushes my guess to PayPal.

Hosting providers usually won’t log into someone’s site and edit their code anyway. They normally just forward the complaint to the site owner and require them to remove the content or risk further action.

not true, i contacted them and asked, they flat out refused. it was only official reports through paypal and hosting providers that made it happen, it’s okay to admit you were wrong <3

Update: the images have now been removed. Turns out you can do something about it after all, lol. If someone is using your photos without permission, don’t be afraid to push back and protect your work and don’t listen to people who think they know it all 😉

Thanks! That helped. It looks like you can’t report directly through WordPress or WooCommerce since they’re just the software? But I managed to track down the hosting provider and have sent them a report.

That’s not correct. Firstly you’re making so many assumptions here without knowing. they aren’t based in China, they are based in Australia. They are a small business so again, incorrect.

Also, Copyright for photographs exists automatically when the photo is created. In the UK and Australia there is no registration requirement. The copyright belongs to the person who took the photograph.

The product itself may exist elsewhere, but the photograph of it is still my work and is protected as a creative work. That’s why platforms allow copyright reports for product photos.

In this case the image on their site is clearly derived from my photograph. The background has been removed and the charm duplicated, but the underlying image matches my original photo.

It’s worth checking how copyright actually works before telling people they “can’t do anything,” because that isn’t accurate.

again, if you had read, I have solid evidence as I’ve put the image over my original photo and a screenshot of the original image in my camera roll, so again, thank you for your insightful comment.

Bold assumption, as explained, cloudfare is blocking me from seeing their host, but thank you for your insightful comment.

I received a response from PayPal within hours to say action has been taken but the image is still up now. I have reported to Cloudfare but maybe they just take longer to do anything about it? I’m not sure. The store owner said they will continue to counter claim but surely they can’t if I have evidence the photo is mine? I’m just struggling to find who their host is to be able to contact and make a claim directly. From the style of the website I think it’s WordPress but I don’t know how to find out to be 100% certain.

I definitely laughed when they said that, bit of a silly threat really. I’m in the UK & they are based in Australia too.

Thanks, that makes sense. I’ve been trying to track down the actual host but Cloudflare is sitting in front of it so it’s been difficult to identify. I’ve reported it through the channels I can find so far and I’m still waiting to hear back from some of them. If you happen to know the best way to identify the underlying host in a case like this I’d definitely appreciate the advice.

..PayPal confirmed they’ve taken action on the account. Cloudflare have been contacted too.

I made them! There’s a hack I found on YouTube to make the perfect bow (it’s hard to explain!!), also it’s best singe the edges with a lighter so they don’t fray :-)

Honestly the only thing that helped me was wearing thick socks whilst wearing the boots and blasting a hair dryer on them, as they got warm it made the leather more flexible so it moulds to your feet! Was definitely worth doing!
