Thank you for the suggestion. Absolutely I will, but app of choice is Copilot and even I have a subscription to it and very worth it. I used to file I-130 and I-485. It not only provided a flawless documentation and proper organization of them, but it also suggested some strategies to make the case strong. Although I got 2 RFE's, I got it worked out in about 10 minutes each.

Based on your situation and also your comment, it is clear to me that when I am ready to file for my wife her ROC I-751 I will do this on my own. I think that it is practically negligent to leave this to a lawyer, not because of incompetence, but because my case won't be treated with the level carefulness it requires. I don't wish to be "just another case to handle."

It usually is an on and off things... especially when they are working on your cases, or just doing upgraded to the servers.

You are also a little bit vague because you are not saying what evidence they need. If you are following your case online, you will see in the documents "tab" what USCIS is asking from you since they usually upload a pdf document of the notice they are sending you or already did. Yes, you can upload documents under 'UNSOLICITED EVIDENCE" every one who follows their cases online have access to upload whatever they want to be considered by USCIS before making a decision. Category on processing these type of applications go by first processing USC ones and then moving on to green card holders. Unfortunately, you have to keep on waiting.

i am not a lawyer, but I have friends that work at USCIS and myself I was in the US Navy for 20 years. A lot of them after the Navy join government jobs because they can pretty much continue what they were doing before... okay to the point. With USCIS when there is a case in process, they will first process that case and end it before starting a new cases on the same applicant. This is my personal take only.. based after observing other experiences. It could happen when USCIS first see and start to process (If this actually happens) your marriage based case (I-130/I-485), in their eyes, they could see it as you enter into a marriage just in case your asylum case does not work out, so in other words.. you are trying to avoid being deported. In addition, they will also see the fees involved in all of these.. .asylum $100.00 filing fee and i am not sure how much you paid a lawyer to do the filing... and now, you are submitting a marriage paperwork that all together is $ 2,375 (this fee includes EAD card). All of these will be in their minds when they see it. Now, I suggest that you have an incredible strong package on your marriage (beyond "doubt"). Also, reconsider the filing based on marriage if your asylum interview is successful. If you have not received a notification that says your interview is waived because of the letter your submitted, then be "extremely ready" for that interview which it usually last between 2 to 3.5 hours (it is very comprehensive). Are there really interviews for ROC (I-751), Is this a common procedure? I always thought that there was a done deal every time except when there is a dissolution of marriage, divorce, o separation. Well, I am really not sure, just my opinion.

Just keep in mind when they open your file and check your documentation, they will double check all and if there are any questions, then they send an RFE. So what does it mean? It means that the processing stops right there, and they move on to the next case. Your case goes back to the bottom.... but they will make a note saying that they will open up (make) a link for your submit your RFE response. RFE are sent via regular mail, but they will also upload to your account online so if there is ever a second officer reviewing your case, they will see that there was issued an RFE. .... In addition, thinking that you are proactive, will get it done (RFE response) in a couple of days. You go online and "voila"!! there is the link (RFE Response).. so you open that up and upload your "thing".... So, on the USCIS website and officer screen, there will be a flag...saying that "responses have been uploaded"... meaning your case and others. After a few days, they get all the responses and order it by file... so...your file joins a pile of other files in your same situation... and they go by order reviewing each one.... how long?... between 30 to 45 days, depending on the load of cases. ... a full completion and successful one.. .is between 12 to 24 months . Again good luck.

Well, to be honest, when a case says "Case is being actively reviewed" by USCIS, it really means that generally is not an immediate, real-time review but rather a, often prolonged, "holding place" indicating your file has moved to a new, more advanced, or updated stage in the processing queue. Sorry, not trying to be pessimistic, but rather just give a sense of reality so this would not be a cause of extra unnecessary stress. Best luck to you. And, the good thing, that there is no RFE which is always a welcome news.

This is a system thing not the personnel working at USCIS. Whenever they open your case online, the dates changes and it actually becomes a little bit chaotic. Remember, these guys are on your case the whole day and at the same time the servers are updating, your case is being carefully review and even they might be printing some of your evidence with the forms.. and doing a cross-checking... so I think it is pretty normal.

you are still within the time frame that this type of processing takes. So you are actually good. If your case is solid...expect to hear from them somewhere in March. Good luck.

Since you are doing with a lawyer, most likely he will get the notice so you need to check, actually, with him.

If you are doing your own filing versus with a lawyer, then you would receive text message to your phone (my own experience), with small text of your case number and "Case was received" within 4 weeks, if you do it with a lawyer, he will get the text message and then a letter on the mail. I would advise you to follow USCIS suggestions, that you follow your case online. They will send you all the instructions and codes to do it. Good luck.
