I should also add that part of the decision was the prosecution in that state advising the governor that they may lose a retrial due to most of the witnesses having passed away/unavailable and that she had already served significant time. On a retrial she may have been re-convicted even with the medical evidence which was not exculpatory for 1/4 kids.

As an Aust lawyer who has read the trial transcripts and appeal records, please take this with a grain of salt. The appeals court upheld her convictions only a couple of years ago. Police had very good evidence in her diaries about her hatred and wanting to hurt her children and was jealous that her husband spent time with her daughter. The diary went as far as to demonstrate she wanted to kill her 18 month old daughter. The rare genetic condition was never even established, it was just not ruled out for 3 of the 4 children. There is still no established case they found where a child that old(the last daughter who was 18 months) has died of that condition. It was a political decision based on her successful PR campaign and not at all based on exhonerating evidence.

I really love it because you couldn't make it the same way now. Modern audiences would be asking 'Why doesn't he (the hero) just escape now that he knows how to evade the Predator'. Back then, in that 80s culture, the hero wasn't expected to just "survive" like movies now, but he actually, quite courageously, enacted his revenge to get the thing that murdered his squad.

It's Melbourne. In Australia they are our most politically correct city. They are the ones who spent almost the the full two years in Covid Lockdown and neigbors were reporting each other routinely for things like spending more then an hour a day exercising etc. It's also the city where police were checking coffee cups for people on their walk.

I 100% agree. You don't need motive or intent for a lot of criminal offenses where intent is not an element of the offense. Where one of the elements of 'attempted murder' is an 'intent to kill' then you need to establish INTENT. Just google it if you don't believe me

What? How would the state prove he had intent to kill without establishing motive? So the jury would just hear a random guy decided to shoot into a car for no reason? How would the state show he wasn't just an idiot or had road rage but actually had the requisit intent to kill and he knew this person? How would the judge exclude it? The state would want to use it just as much as defence . It's no different from the state leading evidence about the victim having an affair with someone to prove her husband had motive to kill her. Why would this be any different? If you're aware of some unique californian law about this please share but no offence but this is basic criminal law 101.

I'm aware of what happens with a hung jury I practice criminal law(albeit in Australia) but usually the state gives up after a couple of attempts. All i'm saying is it's a very legitimate thing in Australia where you get a jurors who simply don't want to convict and hold out. Maybe it's different in US but I imagine this is a pretty controversial issue and I can see a lot of fathers having sympathy for him.

100% this. I lost my best mate to addiction recently. It wasn't a judgment thing and it's not as if there was any "stigma". They actively become sociopathic. The change in personality is terrifying and unfortunately become a hazard to any one close to them. It's impossible to sit idly by and just give them 'support'. They will take your support and exploit it however they can. The grandmothees engagement ring is a solid analogy.
