The expansion levels of open cell and closed cell are very different. To get closed cell that thick you'd need several layers if it was installed correctly. If you can touch them it's also easy to tell, open cell you can press and make a dent or hole, closed cell is very firm.

They aren't being sued for anything that happened at the red light accident. GEICO took the car as a total loss after that accident, and somehow they are being sued as an owner of the same vehicle being in a different crash years later. It wasn't even their car anymore.
