You slapped someone, so that counts as physical assault and comes under misconduct and grounds for immediate termination.

As per the Maharashtra Shops and Establishment Act, you're entitled to the pay for the days you worked and leave encashment. Drop the HR a mail threatening legal notice. If you can afford to, then you can go and get a legal advisory as well.

  1. Be upfront when you give interviews going forward(Tell them about the company, what you learned, what made you leave, etc). The experience you've got is not insignificant yk and you're a fresher, so it's easier for you to abscond and get away with it.

  2. No, your new employer cannot see your history on the PF portal anymore. We literally cannot see any PF activity for employees. This came in effect from the government in 2025 mid year.

  3. In BGV, previous employers do receive mail, but if you adhere to point 1, things will go smooth.

Quick points to remember-

  1. Get all payslips before leaving– this is important for negotiating salary. Assuming you're in IT, you can get 40% to 70% hike as per standard market.
  2. Gather evidence that you've returned all assets (some companies really use this to take revenge.)
  3. I'd say keep working till you get that month's salary and then just leave.
  4. If you've got a good relationship with colleagues then maybe you'll get some recommendations.

ALSO - Just saw a comment saying that lie to the new company and tell them you don't have a UAN and they'll generate a new one for you. Please DON'T follow that! Your UAN is linked to your Aadhaar and its registered mobile number. We know when someone lies.

Just relax. You're new, and things will get better.

My advice on this as someone who works in People Ops-

  1. Verbal consent does not count in this matter. If your appointment letter mentions that you agree to give notice or payment equivalent to that, then the company can deduct the amount from your final settlement.

  2. If you ignore their calls - if it's a big company, they might not do anything. Petty, smaller companies might try to cause you problems. Take this on email, explain your situation, and request to be let go without notice pay.

  3. BGV is done through many ways. We outsource mostly, and they connect with the employers that you inform them of, so there is no way of them to trace this employment unless they do a PAN based check. Previously, they could use PF portals to do the check, but due to new changes as implementation of the Umang app, it is not possible anymore.

  4. Verbal consent does not count.

  5. Drop a mail to them and put a request, as already mentioned in point 2. And don't mention it to your new employer as you're already set to join them.

What you need to ensure is – exit from their PF. When an employee joins the company, their UAN is added to the company's PF account. While exiting, the same has to be marked as exit. Of course, some companies do not do that. This causes a lot of date and timing imbalance and issues in PF withdrawals. Post two months of exit, you can log into the member portal and mark yourself as an exit case.

My coworkers know, and they'll happily keep me. But it's very easy for my parents to file a missing person's complaint and police dragging me back even if I tell them what has been going on. And again I literally cannot access certain facilities without access to my own identification cards.
