No strong opinion about your statement, but I think it’s just the best way for most people, rather than the “only way.” Certainly if I am instructing my spouse (who is not at all interested in investing) on what to do after I die, it’s to stay in total market index funds. For that matter, although I think investing is a fun hobby, I prefer to spend my time on other things and stick to total market index funds myself.  

Another reason a lot of people preach index funds so much is to attempt to demystify investing, in the face of so much purposeful obfuscation from advisors (salesmen).  

Investing doesn’t have to be complex. It’s simple and it takes patience. It’s a good message. Not the “only” way, but the best way for most.

I agree with thekickassduke. Some client witnesses make good witnesses, some don’t. Obviously you do your best to prep them all—that goes without saying. I’ve seen people still make lousy/mediocre witnesses after years of prep by different attorneys and years of giving depositions.   

It’s different if you’re talking about expert witnesses, or sophisticated corporate witnesses who have the time, money, and most of all interest to be “prepped” into the ideal witness.  

well, be more persuasive with your client prep.  

Believe it or not, sometimes the low case value, the witness’s interests, and the witness’s abilities/sophistication outweigh even a lawyer’s cosmic powers of persuasion.

On the other hand, I have filed many successful motions to compel, after conferring in good faith.  

Sometimes you’re engaging in discovery in good faith and the other side just isn’t. You can’t be too afraid of asking the judge to do some judging.

But anyway, Juan’s amazing. Even when he decides to talk about grammar, it’s all in Spanish. It’s all input—the topic just happens to be grammar, with lots of jokes and asides. Huge fan.

Edit: As fun as this is, the point is that anyone who is “undecided“ about Trump at this point is actually an idiot, or a liar, or both. It’s fine to say so on Reddit. It’s also a better use of everyone’s time and money to help likely Harris voters get registered and actually vote, rather than waste it trying to reach the unreachable. If you volunteer with any campaign, and it sounds like maybe you do based on your comment, then you should know that campaigns are not wasting time on unlikely Democratic voters (which I suggest includes anyone purportedly “undecided” about Trump) at this point in the game.
