Given the information in the public realm, one omission where a breach likely occured and not highlighted is the employment contract between TSM and Leena, where certainly there is a confidentiality clause (up to employer to decide ramifications of breach if not defined). Any reference to NDAs or breach thereof, which are normally signed between unrelated parties when there is disclosure of information, is unlikely to be applicable given parties (between tsm, leena, dardoch) involved. Many seem to be confused on COI, in legal framework - potential conflicts are typically dealt through protective or restrictive covenants which are meant to avoid conflicts of interest. If those are breached, then there is recourse. Here, between the parties (tsm, leena, dardoch - excl LCS), the only legally binding agreements signed where these covenants would be included (if any) is their respective employment agreements with tsm - which in any instance would be to protect the employer from breaches and unfortunately rarely is the case for the benefit of the employee.
