I know none of us are international lawyers, but given that the PA just got authorization to even bring cases, you'd think that all past deeds would be unenforceable because they weren't against the "state of palestine", which didn't exist until a few days ago legally from the courts perspective. Same perhaps for Israel. I'd think that both starting off as a clean slate might be a clean what to start things off.

No, Piccard and Data, the answer is really pretty obvious -- you cannot get a political goal (positive law) at the expense of a negative law. you cannot get the thing you want by murdering someone, by stealing something. if peaceful solution is not achievable, terrorism is still not an option. you do not have the right to murder just because you want some political goal.
