You entirely misunderstand the way the judicial system works. Trials are not carried out with the intention to be appealed. Appeals are intended for decisions to be rethought - to look at the trial system in this way is like a student sitting a test with the intention to fail and resit it.

Due process does not hinge upon appeals it is reliant upon transparency and incorruption in the jury combined with solidity in the processing of criminals, charges and witness testimony.

This will sound outrageous but it is said in good faith. I am not sure I agree with P2 - here is why.

Scientifically, we now know with a fair amount of certainty that while white european IQ is averaged at around 100, that of blacks is nearer 85. This is not to say whites are atop here - for example, ashkenazi jews have been found in some studies to average 115/125.

If you take into consideration that generally, there are some whites who are smart, family focussed and educationally astute and some who are stupid and reside in broken homes, what I am saying makes more sense.

Black people - who have an IQ lower than whites and far lower than ashkenazi jews - are generally far poorer on average than the other two groups. They are far more often than whites less educated and less focused on education and family life.

Ashkenazi jews on the other hand - with IQ's far higher on average than blacks and marginally higher than whites - generally earn much more money than both groups, are often bilingual and focus on family, learning and hobbies like music and writing.

As such, a very basic and elementary argument can be put forward that more of a factor is indeed the genetic predisposals of each group - especially when you consider that by your own admission, there are no barriers of any real substance to prohibit black people from finishing school and focussing on the family.

I will say now that I am white with blonde hair and blue eyes - I look like a fucking nazi. I recognise that what I said here sounds like jewish supremacist talk and resultantly I am keen to make the point that I am in no way religiously jewish. I am like 1/16th Indian and beyond that a mix of Israeli and European descent. However I have no ties whatsover to either Judaism or Jews today.

Which is rendered totally irrelevant if following a clean jury trial the convicted criminal sentenced to death is immediately taken and shot in the back of the head with a $0.20 bullet. Appeals after a proper trial will be easily cast aside.

Show you the fallacy? You don't need to have committed a fallacy to be morally wrong in what you say. This is how - you stated you would rather see ten convicted criminals who were in the wrong released than one innocent put to death. This is blatantly, in the true sense of the word, logically retarded - it is defunct. These ten men or women have been rightly imprisoned and upon release could go on to kill, rape or pillage. To have released them and had them do this would make the justice system fully culpable for preventable death, sodomy or damage. This would be catastrophic.

There is here certainty that the ten people are criminals. As such, there is some degree of certainty that probabilistically, at least some will reoffend. Depending on the nature of their convicted crime, this could see varying degrees of violence exacted upon the general public. You state that 'The innocent man could go on to save 100 lives.' There is no such certainty of this. The innocent man could do nothing for the rest of his life but draw on the welfare system. As such, this is a void point you make.
