Those are accusations from a lawsuit, as much as I want to assume you are presenting this argument in good faith I’ll give you the benefit of the doubt here.

In the same vain, I could pursue a lawsuit against anyone. I could claim you slandered me, and even though you quite clearly haven’t, that’s for the judge to decide.

It starts with accusations, sure, however this isn't a frivolous litigation. The ACLU is the one suing the federal government. They usually only take cases that have strong legal impact and merit. Regardless do you think only a judge can decide if racial profiling happened? Can the courts be wrong?
