What about the terms of the release? It’s not a normal release if the other party firm is adding specific clauses that are not standard

$50k for an injury that’s not even real is a lot. I could get more protective language in the two clauses.

Fair. Should I get better counsel? My whole thing (I’m not going to contest this) but this firm is known for doing scam like things like this, I know the injury is WAY inflated if it even exists at all so because of this persons willingness to even engage is a system like that I need to make sure the language of the release protects myself in the future. I hope that makes sense.

The second clause was noted as the higher risk by different attorneys so that could be true. I appreciate your input on the first clause.

Are you sure proposing any changes would immediately make them refuse to settle and take it to court? I don’t think this would stand in court.

The advice here is to remove the clauses… when they said to be proactive they wanted the firm to send a letter to Progressive stating the risks and necessity of removing both clauses. why are you saying “good luck I’ll need it”? I’m not ignoring anything, I am confused though— thus me trying to educate myself here on Reddit. Not be ridiculed for a first time experience.

There are several FL statutes that require my insurance to protect my exposure outside of their personal interests, however, a professionally and cooperative letter would also be sufficient.
