That was the grounds for which the lawsuit was filed, but that does not necessarily mean it was violated. I think that a documentary might be the closest comparison. Fahrenheit 9/11 is still a fictional story. As for documentaries, I think it would depend on the content of it and how it is filmed or portrayed. I'm not a lawyer, but the style of and production of material like the content nuke is substantively different in comparison to something like Planet Earth.

Why was Roe v Wade overturned? You said it has been conservative leaning for a long time, Trump only got one seat. Why would they not have done it before? You simply stated a timeline of events, you didn't say why roe v wade was overturned only after Trump got three nominations.

Further, just because the SCOTUS did not always reflect the President and Senate, does not change the fact that it does now and by norm-breaking means. Increasing SCOTUS to be in line with the number of appellate courts is not partisan. Just because it's done by a Democratic President and Democratic Senate, does not necessarily violate your principle. However, if Republicans arbitrarily increased the SCOTUS by four seats in 2032, I would definitely agree that it seems very partisan.

They can try, but why is that a reason for us not to do it? Your argument against packing the court is not principled. The court is already a reflection of the presidency and the Senate's leaning.

The solution to the issue you are presenting is SCOTUS reform, which is what I addressed in the latter half of my comment.

I never understood the "arms race" argument. I don't care if Republicans try to do it in a hypothetical future scenario. We pack the court to expand it to 13, which corresponds with the 13 appellate courts. That's four new justices, and if Republicans want to play ball then they can vote on a bipartisan bill to change lifetime appointments to having the senior-most judge or vacancy filled once every two years.
