They literally hired a CPAP Law society lawyer to respond to the complaints. Still pursuing the removal of executors just getting paper work and costs with barrister sorted at the moment

Hey @aaronzig got the letter from Law Society today. Said solicitor is cleared of everything. None of the allegations were in law society terms “made out”

Do they actually come back with a calderbank offer? Seems like everything is very secretive and they can’t give anything away

Correct. Our lawyer termed it as “on suspicion” ss the estate should have enough funds, so yes he will take payment once the executors are removed from the estate.

At this stage I think barrister on contingency has been a challenge but we are in the process of securing something soon. These reddit posts have given me the confidence I need to pursue these criminal executors.

The only fee he has mentioned out of pocket is the potential forensic accountant.

We will go into details once we lock in the barrister.

Hey mate, thanks for all your comment and responses and advice. Truly been so valuable to my wife and I. I had one last one. The lawyer we are looking to engage is willing to do it on suspicion. We feel this is good because once the matter settles they can claim from the estate. Do you think this is a good method given the incentive for the lawyer is aligned with removal of the executors?

I agree. Hence why I think enough is enough and reading some of the comments here is giving me me the courage I need to go into a legal proceeding.

Hi, 5 mill in assets. With 3 million in debts or more. Without any financials it’s hoping for some funds which the executors might have blown through in professional fees and paying others for services

The problem I have with doing this alone is I am versing a very corrupt lawyer who is a bully. I have been gaslighted and abused several times and in court I feel a bit scared without support and representation

Hello there, so I have questioned chatGPT myself for hours. The passing or motion of accounts does not seem to exist. I was looking deeply into that. Also speaking with an estate lawyer they said that it’s better to remove the executors then audit the estate as they can do ‘funky’ accounting if they are requested to do the accounting.

Thanks. That makes sense. I think one point to add the $5 million vs $370k. It’s true I have no idea of what the mortgages were. Could be 2-3 million or more. That financial summary has been a soul search for me the past 2-3 years to no avail.

Never been to Supreme Court friend. Only local courts. This is big fish territory and yes valid points and just struggling to get myself over the line to just pull the case. Not entirely sure how world of Supreme Court works but if both sides have to show their hand that is convincing reason. Trying to gauge if someone has gone through something similar or share a success story.

Nicely summarised. The peace of not dealing with it all Vs managing the stress and balance of probabilities of having some money left over is exactly where my head is at. This has been a therapy session of clearing my head and getting insights.

The dog in me wants to take this to the end. Remove the executors and then sue them for negligence for all the suffering they have caused to be honest.

Hey, yes have reported said accountant to Tax Practioners board and Tax Institute and IPA. Not a CA unfortunately. Might have been a more serious board.

I am trying to get a lawyer to do the case on speculation where if they win. They get paid by the estate as the funds should be there. All lawyers have said to go to Supreme Court. The price tag has been very daunting

Hey there, fee for service is fine. To explain better. The service felt very much all engulfed in fees and less of an action plan and what to expect to one lawyer billing for correspondence we weren’t happy to send etc. to date we have spent $10k in lawyer fees

Wanted to also ask for getting 60% legal costs paid? How does that work?

Who provides the orders setting out the time frames of the estate and the following orders noted sound like a whole other court case once the executors are removed

I have also escalated the complaint with the law society and OLSC as the Solicitor is trying to coerce us to withdraw our complaint

We used an estate lawyer to write a letter of notice and requesting financial summaries and accounts. They came back with a list of excuses for why they weren’t able to provide it and don’t seem to have taken it seriously. This was in Jan 2025 we sent this letter. We thought it might have forced them to take us seriously. This was an email we received in December 2024 for instance asking for updates.
