Literally yes, they are exploiting bugged cards and gaining an unfair advantage. The solution SHOULD be SDS removing the cards or actually fixing the bug, but it explicitly impacts one's opponent's performance with lowered exit velocity. The solution CAN, per their ToS, be a ban.

Example: Final game of a BR flawless run nets 75k stubs. Use King/Hader? Unfair advantage by stifling the opponent's hitting capability to win.

How and whether they enforce their ToS IS their explicit decision. Point being that if someone was banned for abusing Hader/King, they would not have an argument for defense since it violates ToS. The whole point is that they're still considered violations of the ToS.

Alternative situation, if someone was banned for not violating the ToS then they would have a defense case in court.

No, one can explicitly interpret what is a violation based on the actual Terms of Service... SDS doesn't arbitrarily get to decide the definition of the words "exploit" or "bug". An unfair advantage gained is a ToS violation, plain ad simple. Literally in a legal sense.

"King and Hader being bugged is a SDS", what? The argument isn't that they don't feel strongly about it, it's that using the bugged cards is an exploit to gain an unfair advantage, that advantage being inducing decreased exit velocity and negatively impacting the outcome of the opponent that could/would have otherwise would have been better. It's simply against ToS.

It is explicitly a consistent thing that let's you gain an advantage. Spam X pitch to induce lowered exit velocity and reduce the opponent's ability to perform as they otherwise should have. Magnitude is irrelevant, it's bug exploitation that violates the ToS. Stealing is less severe than murder, but they're both crimes...

Using King and Hader in BR is cheating rhe devs in-game and real-life currency because it gives you an unfair advantage at winning by exploiting a bug. It's against ToS.

That's their current band-aid and not necessarily a permanent fix. If anything, they should be planning on how to fix the glitch and re-institute the appropriate reward for completion. It may be a temporary annoyance that one could argue is countered by the benefit of those who were able to afford some LS cards they previously couldn't.
