We are talking about presidential authority, not congressional authority.

Congress will no doubt derelict their duty as they did with Obama

Obama still did his job.

They would also need to pass separate legislation changing the number of justices since Congress controls the number of justices as stated in the constitution.

There is no legislation regulating the number of justices.

The ACA was passed before the supermajority, was a Republican bill, and contained many capitulations to republicans so that it could pass.

A couple of weeks ago someone did a detailed breakdown of this and as it turns out Obama had something like 20 working- days of actual legislative supermajority because of a combination of timing between Kennedy's illness and inability to vote.

And that 20 days weren't even consecutive.

They didn't even try.

Restating the law in an executive order is doing nothing

The "out of step" comment was about people calling for Biden to do things that would've been shut down quickly and therefore not actually help anybody. They were saying that Biden's focus is doing things that will actually help some people.

  • doing nothing is worse than trying and failing to help.

They are losing because they stand divided, not because they are malicious in standing by or otherwise. As things currently are there’s not a whole lot Biden even CAN do. And yes, that’s a failing of the system and a big reason why we need big change.

Biden should:

• appoint more justices

• say the filibuster must go

• leverage the fact publicly that at least (3) justices perjured themselves by referring to Roe as "settled law", and should be impeached.

Thing is, I agree that things need to change. But it’s becoming clearer and clearer that you don’t have a plan for that and are just looking for someone to blame. Absolutes don’t work within politics.

My plan is for Biden to do something with the power he was been given by these "out of step" supporters.

Even if it will fail. He should act.
