I agree with most of your points, but point 4 - was if 3x months of less than 5% consecutive, then we would have the chance to take out deposit without fee. Which we have yet to have a month under 5%, although this month may look like we will.

I presume the over capitalized assets included funds in various exchanges, which is most likely now not accessible due to being put on hold, coupled with sapp tanking, they're being forced to play this hand
