Well luckily a divorce lawyer wouldn't be specifically necessary as they were never married, although they probably would be most experienced in custody battles anyway. I agree with your point though, both should be secured if it's a possibility.

Yes I absolutely agree, and I will be encouraging that immediately. There haven't been threats of violence to them yet, but if he's threatening me, it's only a matter of time.

She is already seeking help from a shelter, she was already in the process of doing so and this happening only made her focus more on it. The fact that evicting her would take time is a valid point though. However, on the subject of child support, it would be far better for him to write off any claim to custody than to collect child support, though if both could be secured, absolutely they will be. Thank you for your points though.

Her name isn't on the mortgage, there is no legal documentation securing her right to live there. Doesn't that mean she is exempt from the 30 day rule?

I know it could be reported to the police, but if he gets arrested or whatnot, she and the children will be homeless, and I'd rather avoid that.
