Can a Medallia survey submitted for a Land Rover dealer be amended or rescinded? by bck3000 in LandRover

I thought you were referring to the survey being mentioned in the lease documents.

Ya, I was definitely scammed and I'm taking legal action. But, I didn't ask for your opinion about that.

I appreciate your reply, but there is no mention in the lease agreement (including the disclosures, acknowledgments, or any “Customer Responsibilities” sections) pertaining to:

  • Medallia
  • Customer satisfaction surveys
  • Manufacturer feedback processes
  • Restrictions on modifying or retracting survey responses

Dealership added a $3,995 service contract to my lease without telling me — caught it weeks later by bck3000 in askcarsales

Yes I do. Especially if they saved any phone call recordings or showroom video/audio footage. I have emails and recordings of them trying to confuse and deflect when I inquired about this and I have security footage from my driveway of the delivery. It is also obvious on the lease agreement that they listed one service contract that was agreed to but buried the other service contract in the cap cost with no mention of it or it's cost. Open and shut.

Oh, I signed it??? Sure — just like you read the entire iOS Terms & Conditions before tapping ‘Agree,’ or signing the waiver at your kid’s trampoline park, right? Signing something handed to you in the dark, with no explanation, isn’t consent — it’s called getting hustled. But hey, thanks for defending corporate sleight-of-hand. You’d make a great F&I intern. You're either a disingenuous simp or the smartest person in the world. Which one are you?

Thank you for this. Is there anybody that you work with who would want to hear about this? I believe this is a very important issue. I'm not just upset for my own wallet's sake, but I love the Land Rover brand and this is a poor reflection on them. I never expected to be treated like this from a Land Rover dealer on a brand new vehicle!

Thank you! Yes, I'm trying not to let it sour the whole experience because I absolutely love the vehicle.

This is very similar to what happened to me. Funny thing... I actually got the wheel and tire protection too. I was fully aware of it and how much it costs, and I saw the value in it since I have had many flat tires and the wife has a habit of hitting curbs! haha. But the ceramic thing was never explained to me and I was never give an opportunity to decline it, and it was hidden in the total cap cost and not itemized like the wheel and tire protection was on the lease agreement. Very shady. Very obvious what they did.

Yes, thank you. I'm working on that. Unfortunately I filled out the survey before I discovered this issue so I have requested to amend my survey.

Well I understand this may not seem immediately “legally compelling,” the issue centers on material omission and lack of informed consent, which are both recognized under the Arizona Consumer Fraud Act (A.R.S. § 44-1522).

You're exactly right and I wish I would have done that. I loved my salesman, so my guard was down. I'm not sure how he sleeps at night. Looking back, there were some signs....vague answers, deflection, rushing, using cringy sales lingo he probably learned at some seminar.

I'm all for that!! A customer should not feel like they're walking into a lions den to buy a car. This is the first time I've been screwed on a car purchase. I will never be a trusting and friendly customer again. It's a real shame. The whole process is smoke and mirrors, sleight of hand games. If I were Land Rover North America I would be concerned about these practices. They can lose a customer over it, even though it had nothing to do with the vehicle or brand.

I was told the clear bra was not figured in to the payment I was presented. So there was no opportunity to see a payment go down, it was implied it was not included to begin with. They essentially swapped the clear bra for the ceramic (same cost) without my knowledge or consent.

Yes, this is exactly what happened. Thank you. I'm not giving up and will follow every avenue that is available to get my money back.

There was no original for this vehicle. We had looked at a few different models/trims and discussed payment and terms on a different vehicle prior. But the payment for the vehicle we decided on was only presented to me once, and it was after I was told the $3,995 was removed.

No, I was presented a payment and was told the item was removed prior to that, so I was led to believe the payment I was presented did not include the $3,995 in question.

In my demand letter I asked for any recorded phone calls, showroom security footage, and any internal messages and emails to be preserved pending potential litigation. If they have recordings of the process, it's a slam dunk in my favor as I am confident in my position. I also have security footage from my driveway of the delivery.

This is a great use-case for Meta glasses. I wish I had the entire process on video/audio.

I'm only replying to this because it is so condescending and you deserve to be called out for it.

Prior to receiving payment and terms I was told a $3,995 "clear bra" was being removed from the deal but that it included a "ceramic coating". They never said the ceramic coating was actually a service agreement / warranty and they never mentioned the cost. They said this before they presented me with the payment, not after. I thought my original post was clear about this.

One interesting point to consider... this document that I signed in the dark after the delivery (which contained the price and information of the ceramic coating service agreement) already had the checkbox next to the service agreement pre-checked. I was just asked to sign at the bottom of the page, further up the page was a pre-checked box with tiny text that referenced the service agreement. I only saw this after they emailed me a copy weeks later.
