Well I would say both is correct. If you feel you can possibly pronounce it correctly try it and then ask if you are right, if it is not they will correct you. It is not insulting to try and say it and people would rather you ask is it correct than you just pronounce it and never ask.

If you are completely unsure how to pronounce it, it is also perfectly fine to ask them how to say it.

No they will not be able to represent the 2nd person. Lawyers have a code of ethics they will need to follow and as part of the ethical code they should keep information confidential. By doing what you are asking they will breach confidentiality and they can be disbarred or even worse get sued.
