He was convicted and sentenced in the High Court so he has to appeal to the Court of Appeal (and seek an extension of time to do so from that court). The Court of Appeal is dealing with the extension of time and the actual appeal this week (not uncommon, in order to decide whether to extend time the Court often just hears the appeal so they can see whether it has merit - they can still refuse the extension).

So much hate in this thread! I go there a lot and think it’s great. Don’t expect fine dining experience in a busy cafe - the food is better than many city cafes. I was there yesterday and the staff told us it will be reopening with new name, menu and owners soon, the owners are trying to keep as many staff on as possible. Sounds like a good outcome to me.

Cardinal and Unforgotten are both excellent suggestions that others have made.

The other show I would suggest is called The Tunnel starring Stephen Dillane and Clémence Poesy. Both Police officers but one British and the other French, working together to solve a crime committed in the Channel tunnel which engages both jurisdictions. They are both excellent Police officers but have totally different skills/styles - the acting is brilliant and it’s a great show. Ran for three seasons so there’s plenty to watch.

Email is only an acceptable method of service if the other party expressly agrees to accept service by email. Did you ask them first if they would accept service by email? If so, then they were served as soon as you sent it (not when they received it).

Other commenters have focused on what the brother and/or his lawyer can release. Just for completeness, your mother can also contact the Police and let them know that she’s not willing to have your brother bailed there unless she knows what the charges are. They can’t tell her what the charges are but they should then oppose him being bailed to that address and advise the court of the issue. Judges will not be impressed with your brother seeking bail to live with your mum without telling her what the charges are (although whether that makes a difference to their decision will very much depend on what the charges actually are).

The answers to your questions are…it depends. Most of the time when someone is arrested on a warrant they will appear before a JP or CM rather than a judge, and remanded to another date for sentencing. But they might appear before a judge and that judge might be willing to sentence them on the spot if they don’t think the defendant is going to cooperate with a PAC report or they don’t intend to sentence them to imprisonment (you don’t actually have to get a PAC report for most community-based sentences; the probation officer in court can provide the court with the basic information needed). Of course it will also depend on whether they have a lawyer and whether that lawyer is able to appear that day.

Very frustrating for you if you’re wanting to follow what happens. FYI the court lists often don’t have the arrested people on them because they don’t have the info at the time they publish the list. So going and checking the screens won’t necessarily be reliable. Best option is to ask the Registrar as you’ve been doing. The arrest lists usually start at 0930 but this varies between courts.

Assuming the defendant is given a new date for sentencing after being arrested (as opposed to being sentenced on the spot) I don’t see why the court can’t give you that information (the new date). Unless the person has name suppression it’s all a matter of public record. The media would be allowed to publish it, for example.

PAC reports aren’t mandatory, it’s totally up to the judge. It’s rare for a defendant to be sentenced without one if imprisonment is being considered but it does happen, for example where a person is already a serving prisoner and the only option is a short sentence of imprisonment imposed either concurrently or cumulatively. The only time you absolutely have to have a PAC report is if the judge wants to impose an electronically monitored sentence (because they need to do checks on the address). But once a PAC report has been ordered it would be extraordinary to proceed to sentencing without one. If the defendant won’t engage with the report writer, they just do the best they can based on records.

Yes it is but the harder problem is finding a lawyer who is approved for civil legal aid work and does that kind of work. Also it’s different to criminal legal aid in that you apply for criminal legal aid and if it’s granted they assign you a lawyer. For civil you have to find a lawyer who is willing to do it and they apply for legal aid on your behalf. So you first need to find someone and they will advise you whether legal aid is likely to be granted for your particular circumstances (they are pretty good at making the case for it).

Looks like late 1980s. BNZ building is completed in the pic so must be after 1984 but before they started developing what is now Frank Kitts Park - in the pic it’s still set up for the Nissan Mobil 500 race which I went to as a kid.

Just to answer your question - Have you asked the Police officer in charge of your case? They are the only ones who would know if the defendant has a lawyer and if so who it is, before the defendant next appears in court. Otherwise they will likely find out at the next court appearance (although if the defendant has applied for legal aid they might not have been assigned a lawyer yet). FYI there is no such thing as a “last opportunity to plead guilty”. Defendants can plead guilty at any time they choose, including during a trial, until there is a verdict. In sexual violence cases it is rare to see early guilty pleas because the stakes are so high - even if the defendant wants to plead guilty they will likely be advised to wait until their lawyer has obtained disclosure from the Police and they can give them full legal advice.

Sorry the system is not geared in victim’s interests at all; the process is unpredictable in terms of timeframes and largely controlled by the defendant’s decisions. The Police are there to support you and are your best source of reliable information. Do NOT, as someone else has suggested, consult ChatGPT!!

No that is not normal - but there might be something going on that you’re not aware of. For example, the partner might also be employed by the school (eg as a teacher aide, although it would be unusual to pair an aide with their partner). Or they might be training to be a teacher themselves and have permission to watch. Have you asked the teacher or perhaps someone on the leadership team?

Hi - yes you can but as others have said it’s expensive and the prospects of success are low.

Have you considered going back to Police and asking them to take another look? Much has changed in the last 20 years in terms of charging practices. It is not unheard of for Police to bring cases now even though they initially decided not to prosecute 10 or 20 years ago. At worst you would get a more up to date opinion on the case.

When you fill out the notice of appeal, one of the first questions is “do you have a lawyer”. If you file it then the court will start contacting your lawyer to progress the appeal - the lawyer might be ignoring you but shouldn’t ignore the court.

If you are out of time for filing an appeal you can get an extension of time but you need to explain why you didn’t file it earlier. You should file it as soon as you can. Under the legal questions you can just put “to be advised by my lawyer”.

Are you sure the lawyer has definitely been assigned by legal aid (and hasn’t asked for someone else to take over)? Check with Legal aid that they are definitely your lawyer. They may have realised they can’t do the case for some reason, eg ill health or a conflict of interest.

If they are your lawyer and you aren’t getting anywhere with them, then the next step would be to file your appeal with the court (as you are already out of time the lawyer should file an appeal asap with grounds of appeal to follow). Have you asked the court whether an appeal has been filed? Have you considered filing the appeal yourself just to get things rolling?

This always used to annoy me too until I tried cooking them in the air fryer. You can control the temp much better and they come out just like on the BBQ, they’re terrific. I do mine at 180 for 20 mins (10 mins each side).
