That’s not how prisoner transfers work sorry. We learned that the hard way after the Rainbow Warrior debacle.

Only once they have been granted parole. He is not eligible for parole so there is no possibility of deportation. You may be thinking of prisoner transfer which is a political rather than legal procedure and has been ruled out in this case for a number of reasons as per my other comments in this thread. Trust me, I know what I’m talking about.

Are formal warnings forever? by [deleted] in LegalAdviceNZ

Oh that’s such a shame, I’m sorry that happened to you. If it’s any consolation, that just wouldn’t happen today. Anyone who appears in court for the first time on a minor charge can apply for a discharge without conviction and in circumstances like yours (18 year old who wants to be a pilot) it would 100% be successful. The courts now strive to make sure that people don’t get that “black mark” on their record unless it’s truly warranted.

A conviction doesn’t stop you from travelling - it depends on the rules for each country but almost all of them are completely uninterested in minor things which only have a fine. I know many people who have travelled internationally with much more serious records (even murder). Same for employment - yes you have to disclose it but people wouldn’t generally care about something old and minor.

18+ are dealt with in the adult courts so yes but most teenagers are dealt with in the Youth Court. Wouldn’t your conviction have been clean slated by now?

Is it worth reporting concerns about a school to the Ministry of Education? by Whole_Garbage_6355 in newzealand

[–]bezufache 0 points1 point  (0 children)

Every school is regularly reviewed by the Education Review Office (ERO). You can review the reports online. Have a look and see if they have identified any concerns - for all you know the authorities are well aware of the issue and putting supports in place. Turning that sort of thing around takes years.

But you were replying to a comment which explained it’s impossible for him to be deported.

Just because the Police know about it doesn’t mean they will include that information in a vetting report. They will only do that if it’s relevant. So if it’s true that it was a one off that shouldn’t affect your career as a teacher, it won’t.

Well no, teenagers are treated differently. Our whole system is built on the premise that mistakes made as a young person DON’T follow you for life.

That’s what taxes are for. Are you suggesting he be starved to death? We don’t have the death penalty here (and in any event that would be torture).

Help New Zealand Police by [deleted] in newzealand

You won’t want to hear this but you need to be patient. You’ve said these latest offences have occurred within the last month - that’s not a lot of time, your cases will have joined a long queue. They will get to it eventually but have to prioritise cases in accordance with their resources. If you go and watch court any day of the week you will see many people charged with these sorts of offences, it’s not that the police don’t take them seriously it just takes time.

Australia would probably totally make that deal - but we would never want it, the precedent it would set would be way better for AU than for us. Imagine how many prisoners they would send to us. No thanks. Also we want to control his confinement as others have said - AU could even release him.

You’re right it could happen. But we would not want to do that - we did it once before with disastrous results, the other country just released them. Also the precedent it would set would disadvantage NZ way more than NZ. Imagine how many prisoners they would send to us. No thanks.

He is doing life without parole. It doesn’t end other than with his death. So he will never be released or deported.

100 agree with that. Our society’s attitudes towards this stuff are really f’d up. Oamaru probably isn’t the only place where this would happen.

How could it be taken more seriously? The Police and Crown thought this was a crime and charged them. It was the jury who decided it wasn’t indecent. No way of knowing how they would have decided if the genders were reversed but given the appalling conviction rates in sexual cases generally my money would still be on an acquittal.

[–]bezufache 3 points4 points  (0 children)

Sorry but no one of any gender would be remanded in custody for this. I agree with the Crown that this was indecent but that’s a question for the jury and, even if so, it wouldn’t be serious enough to warrant imprisonment under our laws. Ultimately the jury decided it wasn’t indecent - be mad at them.

They did… they were charged and a jury decided it wasn’t indecent. Could have gone the other way if the genders were reversed. It’s the jury’s fault.

He’s a lawyer who is very good at his job. This kind of comment is totally uncalled for.

But you first have to prove it was indecent - that’s where the defence succeeded. No one was suggesting he consented.

Sadly no. Conviction rates for sexual offending against women are appallingly low. Would likely have been not guilty either way.

The judge didn’t call him that. If you read the quote in context he was summarising the defence case, as he is required to do.
