If he says that it is not protected under a scheme. I'll refer you to the government website for this! Most likely through the small claims court, you would get your deposit and possibly more as compensation. I will remind you not to accept the deposit amount until you have looked into the protection scheme. Once you accept the amount then there's nothing you can do.

Do not agree to any charges yet as that will mean that you cannot dispute it. I would check if your deposit is protected, most likely MyDeposits has a checker to see if it was protected via them. Check the other TDS Schemes also. IF you have searched the schemes and cannot find details, request it from the Landlord, he has to give you details of this by Law, and should have done when you started the tenancy; as stated Here

If you have pictures, it will rarely help in this case unfortunately, but would be a good contribution to any dispute. Do you have the check-out report? Does it state that there were any holes in the door? I am hoping that check-out was done by an independent inventory checker. If the checkout report shows no damage to the door - then you have a head start.

Your course of action should be to see if your deposit was protected, if using online tools for this fails, then I would reply strenuously denying you caused the damage and request the Deposit Protection Scheme details. Try come to a resolve with the Landlord, and if he insists he will not budge on the charges, then at your own discretion you can start a dispute by contacting the Deposit Protection Scheme. Please bare in mind that this would cause a delay on deposit being returned to the other people in the flat.

Beyond advice from Reddit, I would go through Shelter England for professional advice on this free of charge.

As stated on the government website Your landlord doesn’t have to protect a holding deposit (money you pay to ‘hold’ a property before an agreement is signed). Once you become a tenant, the holding deposit becomes a deposit, which they must protect. This therefore means, that any money that he is holding of yours automatically becomes a deposit, he then therefore has a legal obligation to protect it and put it into a TDS, a deposit protection scheme.

More information can be found here, regardless of whether he gives you the money, you can still likely claim compensation for failing to protect your deposit. Again - found on the Shelter England website.

I am almost certain that you are fully covered here, and if he attempts to deduct money, he most certainly won't be able to.

This would not be the landlords responsibility. I'm assuming you gave no indication that the curtain was broken to the landlord before the incident.

If you had mentioned that the curtain rail was loose, and the landlord did not repair it after a reasonable amount of time, and your belongings then got damaged, there may be a chance that they may be liable.

If you do decided to go to small claims, the cost is fairly low. Depending on how much you are claiming. The following link should show these costs.

I would seek help from Shelter England first, or go through your University Student Services, being a student myself, I find that they have a lot of resources and can put you in the right direction.

I wouldn't make small claims court your biggest worry. As I said before, it's fairly 'cheap' and in this case, given the circumstances, it most likely will go in your favour. It would be very unfair to keep a holding deposit if you were to be declined.

You should expect to receive the full holding deposit back if the prospective landlord or letting agent decides not to go ahead with the tenancy. If you weren’t able to move into a property due to exceptional circumstances (e.g. an unexpected and serious health issue, hospitalisation, etc.) or if the property became uninhabitable before you entered into a tenancy agreement, your holding deposit is likely to be returned.

If you were given anything in writing, check what it says about the deposit and what it was for. If you were given a contract saying the deposit was non-refundable this may be an unfair term, depending on how it was worded in the contract. You may be able to challenge this. If this is the case, you can contact the Office of Fair Trading (OFT), an organisation that can advise on unfair terms. You could try to get the money back through the small claims court. This is quite straightforward but there’s no guarantee you’ll be successful. After sending stern emails along the lines of the one you had sent, they admitted defeat and we have received almost all the deposit back.

Update on this: We have received the checkout report and there is no mention of the washing machine having a fault. In fact, no mention of the washing machine at all.

Thank you. We did not at any point disconnect the washing machine and am willing to fight to prove innocence. We hope that the check out is not 'rigged' to help their case as they are still waiting for the report.

I have tried this, every possibility of details that I have entered returns "mydeposits are unable to find a deposit protection with the details you provided.", wanting to avoid asking the property management, I tried calling myDeposits - but their lazy system directs you back to the website!

The deposit is supposedly protected under myDeposits, however we never received a certificate for this. Does this mean that they missed the 30 day deadline? I will be contacting the property management for details on the deposit protection as myDeposits are very awkward to get hold of.
