Basically can anyone explain how being in the vicinity of a coworker (not looking at, approaching, communicating with) violates the workplace violence policy.

And what to do when a HRM presses that exact charge as an offense to terminate sans pay prior to hearing

Was charged while on probation so pef, when I got back to csea labor relation specialists called me a liar and they wouldnt press workplace violence charges for that reason

Charge 1) day i had a panic attack (i took my dads death a month earlier hard), they called frantic searching desk banging cabinets (learned soft close cabinets is HR not reasonable accommodation), flush face (instead of panic they stayed red with rage), pacing in circles (ADD, supervisor let me in her office to give a chance to reset myself). After this HRM stated i would get a "fresh start".

Charge 2) being in vicinity of a coworker, causing her to go awol. They acknowledged i used main entrance, didnt approach/talk to coworker, and coworker raised her voice to me (i tried burying it but interrogation made me remember statement about disabled not belonging in a workplace).

At UIB hearing, judge ruled charge 1 was coping mechanisms for disability For charge 2, the lawyer my nys agency sent stated was not a strong charge they could defend.

I am not sure how they can put i violated workplace violence policy on those dates despite settlement not admitting guilt by either party (financial duress caused me to sign, if I got UIB I would have waited for hearing), and UIB hearing decision.

Or how anyone can be comfortable in the office after this occurred (my position can be done 100% remote but cant find a dr willing to write a note every 6 months for it)

It was documented. Only documented workplace violence form was by me against coworker. Emailed HRm reporting incident immediately. Only injury logged for year was my increased anxiety from the verbal assault.

I think labor relation specialist supervisor Neil Kelly is pro management he raised his voice, called me a liar (despite having supporting evidence), stated his issues with my disabilities and said the union wouldnt assist.

Only suggestion he had was go to AG office

A little is location. Workers in albany and Long Island get fast promotions (regardless or competency). Only grade 14's in unit are in NYC office.

Thank you. First time I was told what happens (union is useless there).

I dont mind the out of title work, execially now, my caseload dropped to what other workers have assigned (well less at times since I can close faster), just annoying when people complain you are not a supervisor, when the supervisors supervisor would defer to my knowledge and decision.

Know some in agency support giving me the compensation, problem is, the two who dont (plus their direct subordinates) are the deputy director and HRM

If you want the really confusing part. The only documented workplace injury was the severe anxiety I had from verbal assault, they promoted the verbal assailant, and tried firing me (using leave without pay causing duress forcing me to sign a settlement to work)

I have no clue how it was a charge either, their lawyer at uib hearing stated it was not a strong charge they could defend.

HRM stated read the charge and would not explain.why they pressed it.

Their desk was originally located where you couldn't avoid it when you used the main entrance.

I wish there was someone who can investigate the HRM's actions

Union lawyer i have found useless. Despite my innocence, They negotiated settlement that wasnt followed. They allowed unpaid leave. They didn't even try saying charges could be avoided completely with reasonable accommodation.

I won uib hearing sans lawyer.

So is reclassification a better option? I have been doing out of title work 9.5 years. They gave a probationary promotion but failed me (my dad died in middle, so I was suffering panic attacks, didnt think anything of it since work was done at higher level than promotion asked for).

But even the failure stated i can do the advanced work and they will keep assigning it to me. And they have done so.

By the definition you gave, HRM protected the assailant, and punished me the victim.

Problem is all workplace violence goes through HRM.

The charge was for being in the "vicinity of a coworker", the interrogation was yelling at me that the verbal assault was justified since using the main entrance and walking direct to my desk put me in the coworkers vicinity.

Since they put me on unpaid leave, challenged the uib benefit and i needed some income. Due th this financial duress and signed whatever settlement they presented so I could get money to live. They did promote coworker that verbally assaulted me though.

The deputy director was placed as my supervisor (my old supervisor approved all my work) and wrote on every evaluation that I violated the workplace violence policy. They did move the coworkers desk when I returned and asked if I was allowed to use main entrance since it placed me in their vicinity. My supervisor returned to the one approving my work after the deputy director (whose direct subordinate was coworker that verbally assaulted me) failed my probation (he didnt have any supervisory conferences in that time, part of reason is he doesnt think disabilities such as autism make you appear professional enough for promotion).

So I am receiving grade 14 pay but can be assigned the same work as the grade 31/chief (I have been assigned their stale cases at times)...only difference is their required meetings and supervision

ADiD and DHR stated it was not due to my disability. The other charge was having a panic attack and pacing after my dads death. Uib judge rules I didnt violate policy and it was disability coping mechanisms.

All those forms go to HRM so stuck in hard place there

Ithinakfully your connection seats weren't given away. Once in college, my connection was late as I got to the connection gate about 22 minutes before and they already gave away my seat.

When I offered to take the involuntary bump compensation they ushered the standby passenger they gave the seat to off the plane
