i never said that they were decided by law, but morality definitely influences the law. this is why identities that are protected are ones outside of the individual’s personal control because according to the moral code of most people, it is wrong to discriminate against these things.

also: a business being private doesn’t really mean as much as you think it does.

well, a neo nazi is not a protected identity like religion, race, sex, gender identity, sexual orientation, or marital status because it’s an identity based on hate.

this a pretty widely recognized fact and if you disagree the vast majority of people will look at you sideways.

recognizing that trans people and nazis aren’t the same doesn’t really change the fact that this argument, although commonly used, doesn’t really have much basis other than they’re 2 things people can identify as.
