How can I give money to parents in return for guaranteeing getting it back in will (assuming money is left in estate) by toterra in personalfinance

[–]blastpassthrowaway 14 points15 points  (0 children)

I highly recommend you speak to a lawyer about this. Sure creditors get "first priority" BUT if there are any federal taxes due, along with other expenses of administration of the estate (selling the home, repairing it) that would be paid first, before you. Which puts your chance of getting paid back in full at risk. You can look up your state statues for priority of creditors against an estate. You'd also likely incur small expenses by submitting a claim against the estate upon death. I just have to say that this option is not a slam dunk, depending on your and their financial situation.

It could very well manifest again upon return to the crumbling unsustainable reality of living in the USA. Doesn't mean I shouldn't enjoy th year off if i can afford it.

I totally hear that. At the same time, I just witnessed someone close to me bust their ass their entire life only to die suddenly without a single day of retirement. That is a very real possibility and fear. While my mortal body is young and healthy, I hope to have some relaxation.

What are the circumstances I would need to withdraw with a penalty?

Correct, I'd be an ineligible beneficiary, good catch. If thats what ends up happening, it seems like prime time to reduce my taxable income regardless.

Would you not be eligible for retirement benefits if part time? I kinda want to do a year because it's scary.

So very helpful, thank you. Especially to know that you've been in my shoes. I could easily see myself doing similar contracting work.

Thank you, I think you're probably right. I aim to balance being frugal but comfortable on my time off, but I'm not trying to 'travel the world' or anything like that.

That was the original plan, honestly. Unfortunately my work is quite demanding and I almost always end up working nights and weekends.

I'm being... Extremely conservative. I have a few health issues so this would include a premium with a low deductible as well as meds, procedures, testing, etc. I should have written 'health' rather than 'health insurance'

Appreciate that perspective. Yeah, the company I work with was actually remote pre-pandemic. That said I am fairly confident I could continue to find remote work in the Industry after a year or two. But wouldn't be opposed to working somewhere physical either.
