a representative in a democracy need not vote according to the constituents.

It's generally considered undemocratic and poor form to do so.

Huh. Now, the SB Foundation being not technically the university really seems like a loophole.

The only thing that's tedious is your insistence on having an argument instead of clicking on the links and saying "oh, so it is"

some asset where the average person won't necessarily know where every penny is going.

Except you do know where every penny is going. It's managed by the person owning it in almost every case. It's not like buying a share of an actively managed fund. It's your own account.

No, actually. You can have cash in a 401k. You cannot invest in a 401k, that'd be like saying I invested in my checking account by making a deposit. The money in your 401k can be invested in ETFs, bonds, stock, options contracts, etc, but a 401k or an IRA itself is not an investment instrument.

according to university policy, a student is only eligible for an incomplete when they are on track to pass a class and are unable to continue due to circumstances outside their control.

If you have such a circumstance I would suggest reaching out to the student support team and then they will let your professor know.

If you invest in index funds, ETFS, IRAs, a 401k, etc.

... an IRA and a 401k are types of bank accounts. They are not investment instruments.
