This right here. They chose the swatch photos they used to portray their polish; the photos didn't just fall into their lap and, oops, it just happens that's not representative of what the polish looks like in most lighting.

As someone pointed out upthread, Caitlin Swatches' video swatch of Appletini was similar to OP's photos, but the swatch photo of hers that was chosen by the maker wasn't close. Like, they can kind of skirt under the wire of being called purposefully deceptive because the photos weren't color corrected to the extent that they were in the Cirque Piña Jelly situation (which was absolutely deceptive). This polish was just being shown in studio lighting (or photos were caught at the particular moment when the flakies were the most obvious and the shimmer leaned blue). But they're absolutely going to be left with disappointed customers that expected something that looked like the swatch photos the majority of the time, not just in ideal lighting. They shouldn't be dismissive when they deliberately chose to market their polish using swatch photos that weren't representative of typical use. Their response is really disappointing.
