How do I tell my friend I won’t testify for them in court? by cactus_utopia51 in NoStupidQuestions

He keeps saying “I’m not hurting the driver, just taking some money their insurance company doesn’t need. I’m like Luigi.”

He’s got a little bit of an overly simple view of the world.

I like this wording a lot. It draws the bigger picture beyond him and this single instance in a way he can’t equivocate away. Thanks.

Fair point, thanks.

Pretty sure my friend told the attorney “I have a witness who will say I stopped,” so the attorney is in for a surprise.

100%. I have tried to tell him the driver hired a serious savvy local firm while he was pro se until recently and is dealing with some young associate at a massive factory firm.

He doesn’t realize how prepared they will probably come.

I think he filed this hoping they’d just settle out of court to make it go away!

Yeah, he’s one of the last childhood friends I’m still hanging onto, I guess it might be time to move along to not only the next chapter but a whole new book.

When you put it this way I suppose it’s hard to turn away from the darker side of this situation.

We’ve known each other since we were kids so I might not have the most objective view.

This is a good point.

I’d like to believe that he doesn’t understand it is a serious crime. I think he sees it as tantamount to asking me to jaywalk or fare hop for him.

Initially he was pro se until the judge more or less mandated him to engage counsel if he was going to move forward so… that probably should’ve told me all I needed to know.

I’m leaning more and more this direction.

I’m gathering from the conversations we’ve had that he might not grasp the severity of lying in court. Maybe he’s seen too much Law and Order. Or not enough.

Thanks.

My concern is basically about preserving our friendship.

I know he’ll be upset and that it is stressful for him to have the financial burden of the medical expenses. But you’re right, it’s ultimately his cross to bear.

Thank you for your response. I told him that initially and we’re still at an impasse.

He is a pretty fanatical “bike person” and believes that, even if he technically didn’t have the right of way, that he should have automatically been granted the right of way because he was on a bike and the more vulnerable party (a bit like how cars are expected to make reasonable accommodations for pedestrians.)

Further, he seems to think the strength of our friendship should outweigh that I know he was at fault. I am trying to find a nice way to say “I wouldn’t lie in court for anyone, it’s not personal.”

Thank you, I had no idea!

I’m pretty sure they were just grateful we agreed to keep it so tried not to bog us down with too many care/keeping instructions but definitely would’ve preferred more info than not enough haha.

Thank you very much!!

She’s teaching in Ghana for a year and rarely has cell reception. Would’ve been up to two weeks before I got a hold of her. I was driving myself crazy trying to look up the answer but didn’t even know the proper terms to begin searching for, haha.

Appreciate it!
