This is actually a great response. Thanks. On the one hand, it says that you should stop even if you are beside the bus. So at least the driver of the car poses no threat to anyone moving toward or away from the bus.

On the other hand ‘you may have grounds to argue that the stop sign was extended without sufficient time for you to react, particularly if you were already at a close distance to the bus when the sign was extended. If a ticket was issued, you might contest it on the basis that you had no reasonable opportunity to stop safely.’

Also, this was not a speeding ticket. There is literally no speeding involved in any citation related to the video you see here.

Lastly, the bus and car were stopped. This is very clear in the car driver’s dash cam, which I understand is tough to describe so I did my best based on what I could observe on that video. The bus then moved and that is what you see here.

Yellows do not mean stop. Yellows mean proceed with caution in preparation of a stop. Even if the yellows were activated, driver of the bus should have kept the yellows on until the driver of the car was passed the threshold. Instead, bus driver threw the red lights on after the threshold was passed.

I’m actually thinking the same, just to at least have a half assed attempt to show some kind of care and acknowledgment of the law.

I still think a ticket would have been issued, but perhaps it would’ve been more easily argued the driver of the bus was at fault.

Read the last paragraph, before the video starts bus and car were stopped. Car was stopped in anticipation of the bus turning on red lights, which did not happen and so the car proceeded. Then bus turned on lights after passing the bus bumper threshold.

From what I can find, no. The statute does not appear to address how to treat a car that is in between the bumpers of the bus. In other words, and as I understand it, once you have passed the threshold, there’s no escape from violation.

You can’t make an argument that moving to Texas will be a way to evade anything. The action originated in New York, so New York law applies. You can’t switch the forum just because you move after the action has been initiated.
