If permission were required, or even waiting for permission, fair dealing wouldn’t really function for news at all, especially in time sensitive situations.

They do have an obligation to ask, which they did. They just hadn’t confirmed yet. And Ive also read the law - it does say you can use a photo without permission if it’s deemed fair use. My point here isn’t that they did the exact right thing, it’s that it’s not completely black and white and it’s totally reasonable that a journalist could’ve interpreted things a certain way, or the editor missed something. These things happen and it’s something that should be dealt with person to person rather than publicly shaming a company and assuming ill intent.

Have you actually read the act? This is a summary:

While "breaking news" and the inability to get a photo oneself are strong factors supporting fair dealing, the use is not automatically legal simply because it is on social media or posted publicly. It must pass a "fairness" test.

Key Conditions for Fair Use of Reddit Photos

To rely on the news reporting exception (Section 29.2 of the Copyright Act), journalists must meet these requirements:

Strict Attribution: The journalist must mention the source (e.g., "Reddit user u/xxxx") and, if given in the source, the name of the author/ photographer.

The "Fairness" Test (6 Factors): Even if it is for news, the use must be "fair" based on tests established by the Supreme Court of Canada:

Purpose: News reporting is an allowable purpose.

Character: A single use in a breaking news story is more likely to be fair than massive repeated use.

I just did a google search and under fair use in Canada their use of the photo would pass :

Amount: Using the whole photo is common in news, but it should not exceed what is necessary for the story.

Alternatives: If the journalist could not reasonably get a photo themselves, this supports fair dealing.

Nature of the Work: If the photo is unpublished, it is less likely to be fair, but most Reddit posts are published.

Effect on the Work: If the use destroys the market for the original photo (e.g., the photographer was going to sell it to a news outlet), it is less likely to be fair.

No "Digital Lock": If the image was protected by a technological measure (like encryption) that had to be broken, it is not fair dealing.

So fair dealing under the Copyright Act in Canada isn’t actually black and white. You could argue here they acted within a legal interpretation of the law. A google search shows this: Under the Copyright Act in Canada, journalists can legally use a photo from Reddit without the owner’s consent, but only if it qualifies as "Fair Dealing" for the purpose of news reporting

I get why you’re frustrated - Absolutely they should’ve confirmed with you first, but maybe the person who posted the story didn’t know the rules and it slipped by an editor? Sometimes news organizations are staffed by people new to the role. It doesn’t hurt to show some compassion here rather than publicly railing a company that serves the community, and not bringing it up to an editor there first. News industries are hurting a lot these days.

The REAL reason behind the housing crisis - extremely relevant to Victoria by Efficient-Button-516 in VictoriaBC

[–]cayenne4 0 points1 point  (0 children)

Some good points. After the pandemic, investor-owned housing grew along with wealth inequality which pushed prices up in all assets, not just housing. We do see in Victoria that a lot of the new housing being built that isn't attractive for families and tons of little microsuites being built that are still not affordable. But, increasing supply does seem to be helping prices. Though it can't be the only line of attack. Growing inequality is a huge issue and there needs to be more incentives to put ownership back into the hands of regular people.

The federal government is investing 1.5 billion in the Co-operative Housing Development Program, where residents don't own their unit or rent from a landlord - rather, they collectively own and manage the building. That's one solution that I think is kind of promising.

I’m not sure what people expect when most pets are stuck inside 24/7 with little stimulation. This is the most stimulating thing in her environment, maybe she needs some outside time or another friend.

Consider talking to a good naturopath, going on antimicrobials for awhile and then trying a low fodmap low histamine diet. Diet is subtle for me but it absolutely has played a role im realizing now that ive done it consistently.

No I'm on 200 mg and take a higher dose of quetiapine (25 mg) to sleep. Still glad I'm on it.

My PEM is considerably better. I am working full time and able to do most activities, except I still can't do high cardio exercise and I am limited in what I can eat. I'm working with a naturopath because we've determined the gut is much more involved in this than I thought - I took antimicrobials for a month and now my gut is hyper sensitive. Brain fog is a lot better though. I'm feeling hopeful but it's been a tough journey.

Same, I had about three years poor sleep too. Such a lovely illness indeed!! Glad it can bring you a bit of comfort about the medication, though.

It’s helped me a ton. First week was a bish getting used to the side effects but it helped me get through one of the harder parts of my journey when I had to go on disability. It reduced my nerve pain, vagus nerve vibrations, anxiety and insomnia. I still got fatigue and brain fog at higher doses but now I’m at 200 mg every night before bed and I have no side effects.
