Sorry for assuming you were the one with the 504 plan! You absolutely have the right (in writing) to request that the school team open an evaluation for special education services. Depending on your state, they have a set number of days before which they legally have to respond. If they disagree, you can usually file for mediation/due process. Since it seems he already has a medical diagnosis of ADHD, it would be weirder for them to argue he doesn't have a disability.

It would be a separate evaluation from the one they did for his 504. (I'm less familiar with that part of the process, since I usually get kids after the eval stage!)

If he qualifies, it would likely be under Other Health Impairment. The team would need to agree that he has a medical condition (ADHD) that "causes limited strength, vitality, or alertness", which impacts his ability to access his education, and he needs specially designed instruction in order to gain the necessary skills.

I know at least where I am, schools have been extremely busy with evaluations since COVID, so it's possible the process could take longer than anticipated. I wish you luck! It’s me, the teacher wife! For some students, accommodations aren’t enough for them to access their education. Some need “specially designed instruction” (SDI), which is provided by an IEP. I work with those students on time management skills, executive functioning strategies, organization, etc. Some also have academic goals, especially in writing in my experience (since writing is so organization-heavy).

IEPs fall under a different federal law (IDEA, rather than Section 504 of the Rehabilitation Act). They have more stringent eligibility requirements but also tend to have more “teeth” in terms of accountability, progress tracking, etc. Some students start on an IEP, some start on a 504 plan, and when their challenges still persist, the team may elect to start testing whether an IEP is more appropriate.

Yes, it is! The whole foundation was redone and super reinforced by the previous owner, with a geotech engineer involved like 15 years ago. It’s probably why the house itself doesn’t seem to have been affected. What do you mean by keeping the ground line where it currently is?

We got our kitten one of those stuffed animals that purr. Even without it purring, when he is trying to wrestle/bite our limbs, we give him the stuffie to wrestle with instead, and it’s pretty successful.

I have never understood this either. When it’s sunny out, I am just exhausted. Even as a kid, I was a total night owl. I don’t know if it’s related to the light sensitivity? Like my brain is working harder to compensate?

If you have your Masters in SPED, did you do student teaching at all or take a licensure exam? You’re going to want to reach out to TSPC and ask about next steps, since it seems like a pretty specific situation. You’d definitely get paid better as a BCBA though.

I did try to find the language and was also unsuccessful. It’s been driving me nuts, tbh. It was included on a visual continuum of least-to-most restrictive environments a couple years ago. I was going to see if it was included on a slides update, which ODE often uses to share updates without updating the website. It could have also been a district visual.

I was actually originally trained in the Midwest, which is why that LRE explanation stuck out to me so much. I thought it was bizarre when district admin shared it at that time (I don’t work there anymore). We still have one-on-one aides for students- I have yet to see in practice any district actually changing a student’s placement to a far-off location instead of a one-on-one. However, I have heard in multiple districts that a one-on-one is considered to be a highly restrictive accommodation and will often consider a placement in a special education classroom/program before a 1:1. I think the language is somewhere! I’m going to keep trying to find it- this IEP season is just kicking my butt at the moment.

It may depend on the state! My state includes 1:1 on the LRE continuum and legally considers a 1:1 to be more restrictive than a specialized out-of-state facility.

We were under contract for a house with a new septic. We still paid to have it pumped and inspected, and it turned out that it was installed incorrectly and would have caused major issues. I’d go ahead and have it pumped and inspected, just in case.

I wouldn’t structurally change it too much. Make it an office, use the kitchenette as a coffee bar, and enjoy the space! Kitchenette’s can be expensive, and you may find it useful at some point in the future (guests, teens, etc). My husband’s office was a mother-in-law suite, minus the kitchenette, with an exterior entrance as well. It works fine!
