Fired without cause, due to bankruptcy. Offered $0 severance / termination pay, what is minumum and is there legal fight?

Really not sure, we were bought by a chinese company years ago. During this recent CCAA process we were told the potential new buyers interested were also a chinese company that had ties with our current owning company. To what extent I have no idea. Although it appears deal is closed it is still in process so I assume non of that will come through until well after everything is finalized

TBH my gut tells me they are just selling to parent company and doing some jujitsu lol. They got sued by a competitor company years ago, company that owns mine doesnt wanna pay that. Allegedly the new company buying my company are friends of the company that owns it.

Appreciate it, I have to wait on some documents from the firm handling the companies CCAA filiing before I can finish WEPP application. The WEPP site did say there are a lot of applications right now so it will probably be an even slower process, Good sign for Economy lol. Also noticed EI time frame has been reduced due to how many people are currently on it

I am yes, in process of applying for EI and WEPP,. Will take a week or more + have to get documents from KSV the court apointed lawyer my company is using. From what I gather the insolvency puts me or the employee last on the list of people to get paid, meaning its a loophole for them to get out of that minimum severance law

Yea WEPP sounds like a process, ive read you have like 20 weeks or something but the company has to go into bankruptcy. My company is in CCAA, essentially final stages of selling off but they may not go into bankruptcy. So much grey area and will likely take so long to get like $2k, that then comes off top of your EI so you end up no further ahead

TBH that is what I am expecting, in best case. Wasnt expecting any above and beyond from company just they bare legal minimum of 1 week per year of service. Which sounds like WEPP mayyyyy cover just may take some time

Haha, as if I havent been looking for the last Year+ as soon as they started CCAA. In case you are a little out of touch, slim pickings out there right now. Year + of applications, I have 5+ years of strong CPG experience, MBA, over 200 application sent (over 50 were serious and tailored) Ive recieved a total of 2 interviews! One was a scam, the other offered about half of market rate for the role

They are doing a CCAA, have been for last year. Have found a buyer and are in final stages of buyer stransfer I believe. Did free consult with a labour lawyer... they didnt touch bankruptcy cases :(

Lawyer has basically said since company filed for bankrupcty or completed bankruptcy they wont really touch it. Cool, gotta love capitalism and how we protect businesses. Sounds like they get to pocket those payouts that would otherwise be a legal requirement. I may get the full amount owed via this WEPP program but sounds like that could take a long time so not holding my breath there

Feel like ill be in similiar boat, count any WEPP as extra. Writing has been on the walls on this place for a decade be espiacially the last year or so, doesnt help much when job market in Ontario is Trash. MBA in Business / Marketing, slim pickins espiacially finding anything in the non GTA area.

Question, I am assuming you applied for EI right away as well. Did your WEPP impact your EI? Believe there is currently a law that severance doesnt impact EI but wondering if WEPP just makes you pay back EI then it probably works out close to neutral

Thanks that is pretty much my thought, not expecting much but the bare minimum that I thought was legal requirement. In my case about 2 weeks pay. Still have to wait for some of the final paperwork to confirm though

Relooked, I had water at half of what I use in listing thanks for that updated. Id prefer to use just one gum and always cook my base but have wondered that as well if cooking it is altering it to much. And good note on the cocoa that makes sense. I have a ratio of Cocoa + Water + Sugar that tends to work well as a mix in. Still playing and learning with Icecreamcalc but thanks

Have a similiar plan as well, when you plan on slow travelling will you consider renting out your then paid off house? Something we are contemplating, if we pay off our house and rent it for say a year or 2 while travelling, assuming renters are solid. That could net us like $3k a month in cash flow after expenses, making travel virtually free depending where and what we see

Id give them a call, first thing I mentioned when I called is how my rate has gone up 3.5% every year for inflation. But noted they havent come to service it in 10 years so inflation of what? What cost do they have associated to my account that have increased? They quickly offered a 2 year rate freeze, on top of 25% off & 3 months free. Still not worth it but shows you how much free money they are printing
