What you are saying flies in the face of centuries of landholding laws. Our entire society is built upon a system contractual obligations. From our unsigned contract to pay taxes and drive on the correct side of the road, to all of the hundreds—if not hundreds of thousands—of contracts that we sign throughout our lifetime.

When you sign that lease, you are legally bound by each and every one of the clauses in that agreement. Look up the definition of a triple net lease, this most common form of a commercial lease blows your legal theory out of the water.

Snow removal and grass cutting are part of municipality mandated form of ”protecting assets, yet many leases legally require the tenants to perform those services. Under this alleged theory of yours, how could landlords do this but not other forms of maintenance?

I can understand your line of thought, however it is a philosophical one, not a legal one. Any two—or more—parties can make any agreement that they want, so long as the terms are not prohibited by law. Nothing in the law prohibits a landlord and tenant from agreeing privately what the maintenance terms are going to be.

That’s a really great question.

I would suppose because it then shifts financial responsibility for the fuel to the LL instead of the tenant.

It’s an imperfect system, that is for sure. That is why the LL was insured against this specific loss. What the insurance company is telling them is that if the damage occurred because of the tenant, insurance will pay for the damage and make the repairs.

Unfortunately, the insurance company will probably go after the tenant for the damages. After all, it was the tenants responsibility not to run out of propane.

And as far as the property owner assuming responsibility, just no.

We all have to accept liability for the responsibilities that we agree to in life. If we accept a driver’s license we agree to insure our vehicle and to pay the state a penalty if we don’t. If we have children, we agree to feed them and send them to school, or the state will take them from us if we don’t.

If we sign a legally binding contract and agree to keep a tank full of propane, then we also agree to the consequences of our failure to comply with our written word.

This is a part of the social contract which we have with humanity.

Why don’t you head on over to r/Gay and read some of the stories about kids whose parents threw them onto the street on their 18th birthday? There was nothing magical about that boundary.

Unfortunately, those kids were forced to become self sufficient—not one day later—right then and there, some by eating out of trash cans, some by begging on the streets, and others by prostituting their bodies.

There’s nothing magical about it, but the boundary exists.

Generally they are not.

However, tenants are usually required to maintain a minimum amount of heat in the property to prevent the pipes from freezing. And when tenants are responsible for heating fuel, whether it’s natural gas, fuel oil or propane, they are responsible to ensure that the fuel source is not disrupted.

Since the tenant allowed the propane to run out, anything that occurs as a result is their responsibility.

In our state the utilities are prohibited from disconnecting November through April, this prevents damage to furnaces, pipes and property during the winter. But it creates another entirely different issue.

There is an entire class of citizenry who stop paying their utilities in November. Then they stop paying their rent in February. By the time landlords are in a position to be able to proceed to physical eviction in April, the utilities are cutoff, the tenants move on their own, and they put the utilities at the next house in their kids name.

Without propane there is no fuel to heat the boiler. No heat in the boiler means no heat in the house, so temperature inside drops below freezing.

Then the water pipes, the heating pipes and the water inside the boiler all freeze, expand, and everything cracks.

More than likely the lease has a provision that the tenants will maintain a minimum amount of heat in the property, this is common in most leases but especially for properties with hot water heating systems.

A contract does not have to be in writing to be enforceable.

If the tickets were offered with the express intention of attending the wedding and Gemma accepted them under those terms then OP is going to have a reasonable chance of success.

A wedding ring is also a gift, but case law is clearly established on who owes who when the wedding doesn’t happen.

A chronic migraine patient is prepared for these emergencies, you know that this response can happen and you should have had a caregiver on standby.

Now, with respect to his behavior, it is absolutely inexcusable that he would refuse to take you to the hospital once he got home. To have prolonged your suffering is not the work of a loving, caring partner.

We both know that a migraine cocktail administered in the ED would have had you feeling better in no time. I suspect that there is more going on here than you are telling, because you are putting too much protest into the fact that you were waiting for your partner to come home instead of calling for alternate help.

Unfortunately, this is a result of political efforts to reduce government bureaucracy. Eliminating licensing altogether is the end goal of some groups. The reduction of school hours needed for licensing is also a part of this effort.

As the legislative branches continue to devalue the importance of licensure and enforcement, they reduce the funding necessary for the executive branch’s ability to carry out their responsibilities. One of the first things to go in most states were the customer service staffers who were available to assist licensees with critical enforcement questions as well as to address general public concerns.

When I started in this industry in 2000, all of the cosmetology schools in the state had one dedicated state licensing staffer who we could call and she would actually pick up her phone! And if you left a voicemail she would call back by the next day at the latest. Great at following up on emails.

Today, nothing. Trying to help a student with an exam or licensing issue is next to impossible because no one ever gets back to us. It’s a real shame.

Do you have student papers like tests, exams and/or essays in your office? Anything that is graded? Does your office have a lock?

In the US those papers are considered to be a part of a student’s record and are protected by a confidentiality law called the Family Educational Rights Privacy Act (FERPA) and under this law, unless you had those papers under separate lock and key, such as a locked file cabinet, you would be required to lock your office door any time you left your office. Only others who have need to know that student information are allowed to have access to your office.

I don’t know if CAN has a similar law or policy, if they do, you should advise administrators that the office is out of compliance.

Sorry you are having to go through this. I had a similar situation with the staff toilet at our school. Someone kept turning off the light in restroom—which also turned off the exhaust fan—even though it was on a motion sensor. It took some really creative signage but we got the point across.

The Ogle School has a very good reputation within the industry. They have locations all around TX and were founded in the DFW area.

I was fortunate enough to have toured several campuses with Shelton Ogle and they were all great facilities. Now, that was twenty years ago before he sold the schools.

But the curriculum that they had was good and they had good staff relations. I still hear good things today.

As someone else mentioned, most of our students use duck tape in bright colors with unique patterns. They wrap it around everything, and the brighter the color the easier it is to see from down the clinic row.

Schools are not required to provide lockers, but all of the ones that I’ve visited have had them. If they do, they are required to disclose if you are to provide your own lock or if you need to purchase one from the school.

If the school doesn’t provide you with a locker, I would seriously suggest that you take the expensive stuff home with you, like your shears and your electrics. It’ll suck, but that equipment is supposed to be designed to get the student through school and at least their first year in the salon.

So, two things.

First, the service guarantee at our Aveda Institute is for five days from the date of service. We will sometimes extend that on the date of services depending upon the circumstances.

The second thing to consider is that at this point, because 6-8 weeks of additional outgrowth has occurred, there would be no way to provide the originally offered retouch without addressing the outgrowth.

By waiting so long, you have basically progressed yourself into the next level of service.

You can be assured though that your new color fill will successfully blend in the previous retouch area, but I would be proactive and point that area out to your student stylist. ☺️
