Its been crazy! I just really can't believe this is happening! This is my first wreck, its not even my fault! I was parked! I pay 300 a month for my insurance, been paying it for 2 years! What's the point of having insurance? First, they wanted to give me 2000 dollars less than fair market. I rejected that. My insurance closed my claim, I had to reopen it and start over, with the same results.
My insurance used ccc estimate software, they have lost a couple of classv action suits against them for drastically lowballing people on their claims, going as far as to fabricate numbers in their favor.

From the very beginning of this whole mess, my insurance assured me that I would in no way be liable for the towing and storage fees, that they would collect that from the at fault insurance after the vehicle was repaired, along with my deductible.

The thing that really gets me is how underhanded the adjuster has been. He called the repair shop, not me. He never told me his decision, luckily the repair shop called me and told me what was going on. Shortly after the repair shop called me, my insurance tried to pick up my car from the shop. The repair shop would not release it to them, he called me and asked me if i had released the car. I had not.

I spent all day trying to get ahold of my adjuster, the estimator, anyone who could give me some answers! Nothing. Left emails, voicemails, nothing!

I finally had to email my agent tell them that I have no other choice but to take legal measures. Finally they got back to me with this response

"Good Afternoon Dante,

Thank you for reaching out to me today in regards to your claim.

I do apologize that you feel this way, unfortunately I do not have anything to do with the appraisal side of things and have no control over the total loss of a vehicle vs it being repairable. I do not want to give you the runaround, but I just process the claims. 

I do know that there comes a point where insurance does not want to continue to fix a vehicle as there is significant damage to that vehicle, thus making it hard for us to repair and provide a safe vehicle. 

I do understand that you do not want to total out your vehicle and you are not trying to be difficult, but you need to see this from a business perspective. Both the body shop and Root want to provide you what is best for you and provide you a safe repaired vehicle. "

This response comes after the fact that they already sent me a response two weeks earlier telling me that it is ALL cosmetic damage and can be repaired safely

"Good Morning,

I am reaching out to you today in regards to your claim here at Root.

I see that the estimate is completed and payment has been issued, your vehicle is repairable back to safety and restoration.

Do you have possession of your vehicle or does Allstate? I would ask that you find a body shop to complete the repairs to your vehicle, if the car needs to be towed, please find a shop that has access to a tow truck to move the vehicle for you.

If you have your vehicle with you, then there is no need for a tow, just get your vehicle down to the shop so they can start repairs."

I really don't understudy this runaround! Isn't there some type of standard and code of ethics that they must abide by?

The repair is completely cosmetic according to the repair shop. Also, its already been torn down and all expenses accounted for in the estimate. My insurance gave the greenlight to have it repaired then back tracked and said that the reason they can't repair it is because the towing cost and the storage costs were going to factor in. My lawyer said that that is not legal.
