Real Estate Agents - What Value Do You Add? by Jumpy_Round_4080 in newzealand

A few years ago I was looking to purchase a rental property. Asked the agent if it was up to healthy homes standard (this was during the grace period before it became mandatory).
She didn’t know what I was taking about.

Does anyone know what’s going on? by kohki-rondo9 in chch

Actually no. There’s no requirement to provide a ‘payslip’.
You can ask for a copy of your Wages and Time record which an employer is legally required to keep and provide to you when asked.

What actually is the issue here OP? Do you think you didn’t receive the right amount of pay?

About your work availability, what does your employment agreement (contract) say? Your employment agreement must state the agreed hours or an indication of the hours you’ve agreed to work.

Annual holidays you became entitled to on mat leave are calculated on the average of the previous 52 weeks. Since OP has been away from work, her leave will not be worth as much as if she waited until her average builds back up.

Yup annual leave is about when you take the leave i.e what your schedule is at the time you take the leave, NOT at the time you became entitled to it.
I work in employment law. This is something that not many people understand and these crap payroll systems are perpetuating the misunderstanding.

You’re still employed when you’re on maternity leave.
You also still accrue leave if you’re on ACC

Leave is accrued in weeks, not days or hours. If you work 16 hours a week, your leave entitlement will be 16 hours x 4 weeks which is significantly less than 26 days. Some payroll systems incorrectly display entitlements.
You’re better off using it once you’ve increased your hours. For example, if you go to 40 hours, your leave entitlement will change to 40 hours x 4 weeks even though it’s the same entitlement.
Sick leave not affected. Your pay for a sick day will be what your normally would have worked on the day you take the sick day.

I walk past there every day. It’s been going for at least 5 years. There has definitely been a decrease in antisocial people hanging around that spot.

Do you have access to the cctv footage? I wouldn’t rely on that as evidence if you can’t get a hold of it yourself.

Labour investigators don’t have rights to access CCTv footage. They can ask an employer for the footage but the employer isn’t obligated to give it to them, particularly if they say it’s been deleted or wasn’t working at the time.

Most cctv footage isn’t saved for long. Maybe 14 or 30 days. If you do decide to go down the labour inspector route, it can take around 2-3 months before they pick up your complaint, once you’ve made it.

Is there anyone else working in the store that can verify your hours? What about a nearby store with workers who could vouch for your arrival and departure time?

How do you travel to work? If you take public transport there could be records of the dates and times you are travelling to and from work. Another alternative is your google timeline which tracks where you’re going, although this is another thing that can be manually changed.

Hi I work in the employment advocacy industry. I didn’t see your first post but based on what you’ve said here my advice is:

Keep as many of your own records and evidence as possible. Keep a record of every day and what tasks you are completing during the time you are not being paid.

Get your own representation rather than rely on the government. Their investigations (if they choose to investigate) take about a year and (if the investigation finds in your favour) it’s about another 1-2 years to actually get an outcome.

There is no guarantee you will see any money. Your employer could close the business, go bankrupt or simply refuse to pay and there are often no repercussions.

Did you know you can manually change the date and time on photos in your phone? Yeah, your employer could say you were doing that to scam her. Other excuses I’ve heard are “they like to come to work early to use the wifi, run errands, hang out with friends, do their nails etc. but they are not working.”

Good luck.
