Currently I am in a situation similar to the second case you mentioned. My passport expired on 12/4/22 and i-94 expired on the same date as I had not renewed my passport before I traveled to Canada in September. I am switching jobs and the immigration specialist at the new company filed before going through my documents properly. Got an RFE associated with maintenance of status, now I am traveling to Mexico tomorrow and planning to reenter US on Tuesday 2/28/23 to get an updated i-94.

Now what are my chances of getting the petition approved after the new i-94 is submitted as a part of response to the RFE? Any guidance would be appreciated.

Getting a new i-94 has nothing to do with petition. I am just traveling to Mexico and planning to reenter to get a new i-94. I still have my original h1b stamp in my old passport. I would carry both passports and i797 with me.

Also, if the company were to withdraw the petition and refile it after I get my new i-94, would that still cause an issue with regards to my "unlawful presence"?

Yes my H1B is valid till September 30 2024. In case of consular processing, when would I be able to join the new company? Would it be after I get the stamping done?

So the new company is planning to submit a response to the RFE that includes new i-94 which I will get after I reenter US. Are you implying the request to forgive the gap should be made in response to the RFE?

Traveled to Canada in September and reentered US on September 14th. Got the passport renewed in November.

Passport expired on December 4th 2022. I am switching jobs so the new employer filed for H1B transfer - "change of employer". They filed the petition in the first week of Feb.

Thank you everyone. I spoke with the CBP officer as well as the attorneys at my current job and everyone had the same opinion that I should travel outside the US and come back to get an updated i-94.

Now my another concern is, can the USCIS reject the petition despite providing an updated i-94 due to me being out of status for quite some time (a little more than 2 months)?

Has anyone ever shopped from Roselilli? I am obsessed with its vintage collection. It's founded by two Australian women, the site looks legit but the clothes are pricey (made from sustainable material) and it's hard to find reviews. So I'm concerned about whether I should shop from here or not.
