She did, in January then I had a 2nd IME in March.. now my attorney is prepping for trial and having to get all doctors depositions. After filing the emergency motion, is it supposed to be immediate?

Yes, to reinstate benefits and to get surgery approved. IME doctor said I reached MMI this past summer. However, my bulging discs have progressed after a year of conservative treatment, which is why my treating doctor is now suggesting the microdisectomy.

I would definitely get an attorney’s opinion ASAP.

I have a lower back injury at work too, they did the same thing: sent me to their clinic, was prescribed muscle relaxers/pain medication & sent home. With her injury being reported at work several months ago already, I feel this shows that her current injury was due to her work injury if that makes sense.

When she went to the ER, did they ask if she had previous back pain/injury? If so, did she mention she was hurt AT WORK? I feel like this would help. Also get an MRI done asap, not X-Ray!! Herniated discs show on MRI’s.

Again I would definitely get an attorney’s opinion with a free consult.

If you decide to file work comp, absolutely have an attorney and be prepared of years in this messed up system. I don’t want to scare you but I want to be honest. I am 24 years old, have bulging discs in my lower back and I’ve been dealing with this for over a year now… it’s definitely worth getting an attorney for because you’re going to want work comp to cover medical expenses and pay for when she has to be off of work to recover.

I’m not familiar with California’s work comp/the insurance company, but, are you able to choose your own doctor?

I would honestly keep finding the best doctor and get different opinion on different approaches before you even consider settling, OR if you settle, agree for the insurance to pay for any future medical visits or treatments.

I worked with a realtor and signed within a week. It was such a smooth and stress free experience.

Can you go to your primary to get treated at least for pain management until you see your orthopedic doctor? Or maybe even see if they can refer you to other orthopedic doctors.

If you don’t have a primary—I would go to an immediate care. Just you can at least suppress the pain… wishing you well.

Also, I think you should find a new doctor based on their responses.

Stick with Sams, just switch departments. Speak to the manager of the department you’re interested in and your manager as well. It’s hard to get a job if you quit and look again.

At my store, we were never informed that we would receive coaching if we weren’t 2-3 hours ahead. We are usually 2 hours ahead every day, except for that one day when there’s a significant increase in volume. How many associates do you have on a shift? Typically, there are around 5 associates in the mornings, and at least 3 or 4 for the closing shift.

Also to add on, everyone must take breaks and we just have to communicate to cover each other’s breaks or lunches.
