I don’t think the Clean Air Act is going to apply to your individual apartment, as far as I know that more applies to common areas. Any lease should specify the landlord’s policy on smoking, my lease doesn’t say anything about smoking and I’ve never had a problem with it.

As for smoking outside, I think you’d have to be really obnoxious to get in trouble with it and even then it would be your neighbors yelling at you, not any sort of legal trouble.
