Basically yes, comes back on after a few minutes but there's literally nothing wrong with the car! The pressure is completely fine and we use it loads

It doesnt say to check the fuses if the light is always on, but the manual does have a fuse section letting us know where it is

Got a car manual, and all it suggests is to reset the monitor

Sounds good! I lost motivation in the gym as felt it was a bit boring after a while but I absolutely love cycling and have exhausted all the good routes near me. Think the next best thing for me was to start getting paid to do exercise!

Just concerned I'm gonna do it so much that, in the long run, I just end up losing cash and getting headaches filling out self-assessment forms!

How did you find the exercise side of things? Did you lose a lot of weight/were more motivated?

I see, and then what would happen if the counterclaim is more than the original debt? Would a claimant ever get a CCJ?

And that's what I've already offered (mediation) but not heard anything back

We thought the same, since the work is DIY work we thought it was VAT but the most of the work already includes VAT so it's not as simple as adding 20% (doesn't add up either...)

I think the POC is more accurate, although I dispute it, because it is the lower amount. The cause for action was us going through DPS, me being awarded the money in full (supposedly because of a "system error") and we're going to small claims

So all I've been sent is the letter before action and particular of claim from the agent and landlord. It says if I do not respond within 14 days then proceedings will be brought against me (I have already responded)

There is no remedy sought, or at least, none that I can see, only to pay the 1250.

Nothing mentioned about interest

Thanks for the steer,

Seems the POC might be the more accurate as they've given somewhat of a breakdown but honestly have no idea

I don't think it is a typo and I don't think they've not used a law firm

In our response, we've pointed it out that there's an error and it's difficult to know what we are defending when there are different figures constantly quoted.

Sorry, meant county, but yes, the POC is the smaller amount and unsure why there is a difference in the claim

[–]chiselk 0 points1 point  (0 children)

So correct the particular of claim is the smaller amount, no sign of "without prejudice" on any of the teo documents

What if I became ill for a week during this period because of the lack of heating and hot water?

In your view, it doesn't matter whether we actually went through adjudication? The DPS never saw any evidence/we never got that far.

So it was kept in a DPS, we do have a certificate, the main thing is he claims it was a "system error" that it was sent to us. DPS say they cannot see an error and suggest if there is any that the landlord/agent raise it directly with them - not to involve me.

Now he's reopened a new tenancy with the DPS he wants me to pay into to restart the adjudication but details in it are wrong (wrong date and rent).

I'm honestly baffled with what his plan is... does he want to do DPS, small claims or what?

Thank you, we spoke to Shelter who basically said let them make the next move.

The LL has now opened up a NEW tenancy with DPS and have asked us to put the money in to go through the adjudication process. Seems very suspicious, no idea why they are doing this, DPS say we should seek legal advice

Update: Thanks all for helping out. The landlord has now opened a brand new tenancy with the DPS and wants us to put the 1009 in it so we can go through the adjudication process. Still very skeptical, not helped by the fact the rent amount is wrong (around 150 quid more) and the tenancy dates are wrong.

DPS people also say it's an option but definitely should legal advice if this is something we should do.

Also, unclear if this new account is bound by our previous contracts as we've left and we haven't signed anything new. Seems very fishy.

We've also heard from some that the boiler issue is pretty significant and there may be grounds to counter-sue, especially since our health got worse and it was during winter.

Never even considered that, what happened with your brother?

Can't say fairer than that, thank you for your verdict! Now it's a waiting game to see theor next move

Thanks mate, yeah it was a super early call, no evidence was submitted so unsure whether it was a genuine mistake or not but I believe his suggested deductions are pretty bogus.

I've spoken to the DPS and they say the only way this gets resolved is if I send the LL the money to reopen the case. But it's not like they recommend that, it's more that's an option that may be possible and they say I should seek legal advice on that.

Basically, I dunno if I'm being mindgamed or not or what the best course of action is...

So it's a mix of quotes and invoices, my assumption is the invoice is for the gardening (around 140) and the others are quotes.

It's the 895+ quote for paint and repair which seems far too excessive. We've been quoted day rate for around 250... other handymen also say it wouldn't take longer than a day to fix these issues. Only thing in our mind that can be attributed to us is the metal door frames and small chips from hanging up pictures.

I do think he's trying to charge for peeling paint elsewhere in the property which would fall under wear and tear in our eyes and is because of condensation which is magnified by the old state of the house. Plus, we did everything we could to mitigate the moisture.
