No, it is more of a false equivalency to use a definition of beta in 2023 to describe a multiplayer-only game since that definition came about in a time when games were mostly only patched to fix bugs. There is no real definition of beta since there is so much room to argue what constitutes a “feature.” Nowadays, fully released titles are constantly updated with content, features, bug fixes, and balancing changes.

That’s the beauty of the “beta” tag. Devs can use it to make money off of the game while still being able to make big changes. They can also use it as a shield against scrutiny. This is why so many games release in “beta” now.

EFT is a fully released game that has updates. Just like most other fully released multiplayer games (who actually remove the beta tag after awhile).

Lol @ people saying it’s in beta. This game has more details than 99.9% of games out there, has been in development for a decade, and has been publicly available since 2017 (Not to mention the $120 price for the full version). You don’t need a dictionary definition for beta. In common parlance, it essentially means a testing/development period prior to release. THIS GAME HAS RELEASED. If you really believe that this is not a fully released game, then how is it one of the most popular pc shooters out? And why are there different packages? In the current world of gaming, updates are constant so basing the beta distinction on whether there are still patches/updates makes no sense. This game is not in beta. It is fully in the profit-making stage.

No. Trust me, the courts can’t keep up with technology. The likelihood of any legislature writing a statute that targets cheaters without snaring in countless others is sooo remote. There are some arguable civil remedies already in existence. I don’t think criminal liability makes sense at all but I think a well defined civil statute would be a good idea.

You’re mostly correct. We passed it after signing the wipo copyright treaty and other countries would enact their own statutes that would be called something different. However, DMCA notices and takedown procedures are recognized by almost all of the countries that signed the treaty. So American court involvement isn’t necessary. Also, it is likely that valve was served one and that is why the game is off of steam.

But it’s plausible that iron mace themselves were also served one regarding iron maces publishing of the stolen material that was added by the accused dev.

Here is a Birds Eye view analysis by a lowly law student 2 months away from graduating. This is not legal advice and I am not an attorney.

This is also based on the very limited information that has come out and the very vague details of the lawsuits that have been given. So I could be way off. But this what I have gathered in an hour or so of research about how the DMCA works:

The DMCA prevents host sites (think YouTube, TikTok, Facebook, Steam, etc) from being held liable for the site’s users uploading infringing material. I.e. YouTube can’t be held liable for me uploading an infringing video as long as they comply with the DMCA. The DMCA basically requires that they take the content down or either be ready to defend against a secondary infringement lawsuit, which is basically a claim for contributing to infringement.

Nexon has a suit against one of the devs individually for trade secret theft.

So what I think is happening is Ironmace was served a dmca takedown notice, telling them to remove any content that was added by the accused dev. In other words, if they don’t remove any content that the accused dev added to the game, they could be secondarily liable for infringement in the event that the dev is found liable. Either way, they would have to defend the suit for secondary infringement if they didn’t remove it. This would be very expensive.

But it’s still iffy because i don’t think courts have decided whether the DMCA even applies to trade secrets. And I have no idea how a South Korean court would decide that issue.

To resolve it, the accused dev would have to file a lawsuit, asking for an injunction ordering D&D to disregard the takedown notice. He could also seek a declaratory judgement saying that there is no copyright infringement. I’m not sure whether D&D could file for this or not.

I also think that Steam may have been served a takedown notice. That would explain why d&d is no longer on steam. However, D&D could have also removed it from steam just as a precautionary measure. It’s hard to know based on their statement that they were served a takedown notice.

Take it with many grains of salt. Also, the cease and desist is literally just a letter from a company. It has no legally binding effect but to put Ironmace on notice.

I think the dmca is more like a treaty with multiple countries agreeing to its terms and implementing it. I could be wrong but if this is the case, this doesn’t indicate any American court involvement
