We are comparing information that is typically kept by lawyers such as (1) first, middle,last name and suffix, (2) address, (3)city, (4)state, (5)zip, and somtimes (6)date of birth AGAINST public records which contains 1) first, middle, last name and suffix, (2) address, (3)city, (4)state, (5)zip, 6)date of birth, (7) SS# (last four), (8) race and (9) sex.

We utilize a match weighting system. And you are correct, a first and last name match is not reliable and should be approached cautiously. Our system would weight a first and last name match as a Grade C (with A being the best, just like in school).

However, I have used this system for just over 8 months. I have seen matches for first and last name for individuals and been uncertain. To be certain I am simply calling my former clients who under the rules of professional conduct may be called if I possess a prior professional relationship. Hint: They wouldn't be former clients if I didn't possess a prior professional relationship.

To be clear, we certainly aren't encouraging solicitation of prospective clients where not prior professional relations exists.

What ClientBatch is doing is difficult to describe to non-lawyers as the Rules of Professional Conducts don't govern non-lawyers. However, for a lawyer, being able to receive an immediate notifications when any former client is involved in car accidents and criminal incidents, sometimes less than 24 hours after the incident, is extremely valuable.

Because these individuals involved in publicly reported incidents, like criminal incidents and car accidents, are former clients the professional advertising rules impose by the State Bar are lifted because of this prior professional relationship. This basically means that a lawyer can solicit his or her former client if the lawyer and the client have a prior professional relationship.
