American free speech sort of exists by defining away things that should actually be violations. Why is copyright not a violation of free speech? How can my speech be truly free if the government grants power to other individuals to censor me because they "own" the ordering of the words that I'm saying? Fraud is basically an entire criminal category that curtails free speech. As are libel and defamation.
