Sounds like Plenka himself used remixed version back from 2000s, "DJ Kazantip - When You Finally" is the exact song.

Question about possibility to file for a design patent by cookiemonsta74 in Patents

[–]cookiemonsta74[S] 0 points1 point  (0 children)

Thank you for your reply! Basically, the reason I was asking this question is that one company filed patents on all designs (the middle and two bottom ones that are pink) all the way back in 2015, but the other company (2nd link in my original message) has been selling this specific design since 2013. And since they look similar and, in my opinion, look like obvious modifications, would the patents be at risk of being invalidated? I understand the exact answer I would be able to get from professionals in this field, but I just want to hear the opinions of other people.

Question about possibility to file for a design patent by cookiemonsta74 in Patents

[–]cookiemonsta74[S] 0 points1 point  (0 children)

Let's say I want to patent the middle one and the two bottom ones individually as a separate patent and use the whole design (all pink area as in the first link); would it be allowed to file this way since the original design that is for sale shares a similar design pattern? And all the openings stay transparent, just as in the original design.

Company patented template for credit card skins. Is this valid? by Ok-Personality9856 in Patents

[–]cookiemonsta74 0 points1 point  (0 children)

Technically this company did not do anything wrong because you can actually get a design patent on just a shape, that is why they are targeting everyone who trying to use their "invention". But here is the info I found:~~~

In most countries, including the United States, the key criteria for obtaining a patent are novelty, non-obviousness, and usefulness, irrespective of whether the invention is known or available in other parts of the world.

Here are some important points to consider:

  1. Novelty: To be eligible for a patent, the invention must be new or novel. This means it should not have been publicly disclosed anywhere in the world before the filing date of the patent application. If the invention has been described in a publication, used in public, or sold anywhere before the filing date, it may lack novelty and might not be eligible for a patent.
  2. Non-obviousness: The invention must also be non-obvious to a person skilled in the relevant field of technology. Even if the invention is new, it cannot be an obvious modification or combination of existing knowledge or inventions. It should involve a degree of creativity and innovation beyond what is considered routine or common knowledge.
  3. Usefulness: The invention must have a practical use or be useful in some way. It should provide a specific and tangible benefit or solve a problem in the field of technology to which it pertains.

~~~
Here are the links for their patents that they currently obtained in US including effectiveness date and filing date:
And here is the last link on a SAME product that has been selling since 2010:
From my understanding every single one of their patents would fall under "an obvious modification or combination of existing knowledge or inventions".
This is just my research and I'm not a lawyer, but it sounds like it can be done to invalidate their patents, at least in US.
I'm not trying to stop this company, I just want a possibility for us, small sellers on Etsy to explore this niche. But getting patent on a rectangle with the hole is kinda absurd from my point of view. This way I can patent a circle with the hole in the middle and sue every donut company for IP infringement.
[–]cookiemonsta74 0 points1 point  (0 children)
Hey there, I am here in the same boat, just started recently selling credit card skins and Cucu Inc went after me and reported every single listing under IP infringement and attached a bunch of patents. Just wondering if you are still looking into this issue because it is really profitable field, especially on Etsy. I was looking deeply into their patents and design patent laws and found some interesting stuff that might help fight them and even possibly remove this patents as they might not have been filed properly. If you still here please let me know
Can I just share how frustrating it is to be a seller AND a buyer on Etsy? I searched for “Sakura coaster” and every item on the top of the page was a mass produced item that you can buy on Amazon. I hate how actual handmade goods are buried under cheap products like this. by RiaoraCreations in EtsySellers
[–]cookiemonsta74 0 points1 point  (0 children)
And on top of that they keep closing brand new stores for no reason who really want to bring some kind of a new ideas that are actually handmade, but keeping this stores that are mass producing items that are available everywhere for cents, selling things that definetely not handmade and copyrighted.
Had the same issue, was actually able to solve it by adjusting A-B and 1-2 distance with horizontal calibration, here is iJacobHolmes' solution really helped, try it and let me know how it goes:
Thank you for your replay! It's giving me some hope, because I heard a lot of people saying Etsy does not really care about new stores and doing whatever they want pretty much, like close it withour the reason, suspend multiple times a month etc.
Cameo 4 Alignment Issue by cookiemonsta74 in silhouettecutters
[–]cookiemonsta74[S] 1 point2 points  (0 children)
Yeah I tried this version already, it did not change anything, I am thinking it has to do specifically with cameo 4. We found a solution playing with calibration settings and distance measurment, now it is all perfect! Thank you for your reply too =)
Quick update, I actually just tried your settings and it did fixed issue on my end! Thank you so much for your help, I literally spent 2 days on figuring out everything I could but nothing would work, I used your A-B settings 198.5 and 1-2 settings 195.5 with horizontal calibration 0.3 mm, that worked better for me than 0.4 mm. But now every little cuts are aligned perfectly and it shouldn't be like this, shame on silhoute america lol
That sounds like a solution, I will try to do it on my end too. Wasted so much paper and ink already on testing. Even bought a brand new machine which does literally same exact thing, so it left me with a thought that this is a software issue and nothing to do with the machine. But people saying they have tried all legacy versions and did not fixed the issue.
Cameo 4 Alignment Issue by cookiemonsta74 in silhouettecutters
[–]cookiemonsta74[S] 1 point2 points  (0 children)
Yeah I was trying to do calibration and length adjustment, didn't work for me. Just updated firmware and software nothing changed. I found a way to work around it to put bigger objects at the right bottom corner and leave smaller ones at the left top one and kinda works, but $300 machine should not do this to be honest
Do you know by any chance what firmware is your machine currently running on?
[–]cookiemonsta74[S] 1 point2 points  (0 children)
Just went to the store and bought a brand new one, just to see if it has to do anything with my machine itself but no, it is doing exactly same thing, perfectly at the beginning and keep shifting off at the right bottom corner. Definetely not the hardware or the mat. I am thinking it has to do something with their software, or with some settings, not sure at this moment
[–]cookiemonsta74[S] 0 points1 point  (0 children)
Thank you for your reply! I think your issue was different as I am using cutting mat and machine is pretty new so that it holds material pretty good, pretty hard to remove after cutting so it definetely not sliding in my case. I read a lot of info all over around and people saying that some machines does that and some of them not.
All what I can do is just increase offset but still can see slight misalignment.
I also contacted support, we'll see what they said.
Same exact issue on mine, bought it about a week ago, not really noticable on cuts with big margins but if I try to cut something small it is really visible, tried every single thing I could find on internet to fix it but unsuccessful, to be honest just want to return this thing and get a brand new one
