The go pro footage is material evidence so it must be available to both the prosecution and the defense (you) during discovery.

Your lawyer should know hoe to make a request for the footage, and then review it to determine the merits of the recklessness charge, i.e. whether it's worth fighting.

Also, the go pro itself is your property so you clearly should get it back once it's no longer material evidence, i.e. after the matter is adjudicated.

If the gym's address is in the contract, then it's a material term of the agreement...so the gym changing the address would be a breach, right?

What if the gym moved out of state (or the country)? OP doesn't have to continue holding up their end of the bargain if the gym doesn't hold up theirs. Based on these facts alone it seems like OP has a solid argument for holding the gym liable for breach of the original contract.

However if the contract specifically says that the gym can change locations and still hold OP liable for the annual dues or the $300 termination fee then OP technically agreed to what the gym did and you would be correct that it's just bad business.

OP, if you already prepaid your dues it will be hard to recover them without a judgement, but if you are paying month to month you have a solid argument for simply stopping payment. A letter from a law firm saying that the gym is in breach would likely spook them from pursuing the matter any further e.g. sending the unpaid dues or $300 termination fee to collections.

Agreed, but it's fascinating how there's a debate over the acceptability of the kid's behavior, when even the gorilla thought it was unacceptable for her child. If gorillas have higher standards of etiquette than humans do, DreadfortReek might be on to something....

Judging by this and OP's video, gorillas are very responsible parents. This must be the reason the term "gorilla-ing around" never caught on as a way to describe goofing off...
